Claiming he entered into some defacto guardianship agreement takes me right back to the old lady.

This guy was deceived, and helped the children - but by doing so doesn't make him any more legally liable than the guy that helps the old lady.

i see what you're saying. any children born out of the marriage - even if they weren't biologically created by both parties - would be under the guardianship of both the husband and the wife. kind of like other property that is accrued during the marriage - regardless of who actuall PAID for it. i.e. if the woman doesnt work, she still gets 1/2 of all assets that came about during the marriage. and now the man is also responsible for any children that are born during the marriage, even if it was a result of his wife's infidelity.

i still dont like it though.

well it's not like a physical contract i don't think, but i'm pretty sure if your wife has kids while married to you, you are their legal guardians by default.

it's a shitty, shitty situation. and i think that the woman should be punished somehow

umm by default he would be the legal guardian
