Anyone ever have to battle a close family member over an inheritance?

So your father didn't leave anythig to his wife when he died?

I know it's late, but damn you really need to have a will. $40 gets you a will these days. He owned .5 mill in property, he needed a will. Sorry man, that doesn't help you out, but still, haven't any of you spoken to him? good luck with it.


Tell your mother "Yeah, you'll get $50k. Sell the building (with her consent) then RUN! lol jk

1/2 a million?There is another 760k in mutual funds that mymother holds the key too as well as a 560k house paid for.Im just pissed because iv'e waited 5 years and now have my head on straight and want what my dad wanted for me.

Was there ever a written will?

Do you know who "heard" the will? That's a large part of whether or not you even have a chance of this verbal will even being considered.

In most states, if a person dies without a will (like in your case) all real property goes to the surviving spouse. if he died 5 years ago, probate has been completed, that will either give it to you or whoever..

something is missing here..

1. Family fights over money are the ones that destroy the family, and whoever you think is on your side NOW will not be in the end.

2. If you don't care about point #1, I take it from what you said there is no written will and everything is basically verbal. Legally your ain't entitled to shit, only his wife is (seriously, depending on whose name is on the deeds. Children are not legally entitled to any inheritance if there is a surviving spouse). Lawyers will drag it out and everything will get sucked up in legal fees. You end up with zero cash, zero assets, and the family hates each other.

I watched this happen between my aunts and uncles when my grandparents died. It was ugly as sin, took more than a decade to resolve, and in the end the only people who got shit were the lawyers.

Good advice.

My uncle riped off my grandmother and my mom. I could have gone after him. I didn't. He thinks he won but I won because you never fight family over money, no matter what.

I may die poor but I will die with dignity and honor.

He won't.

my Mother has instructions in her will for me to change the front door locks the moment she joins my Father.....Payback for the other kid's behavior.

you better have the original will.. not a copy, the state of NC said no to a copy, plain and simple..

lucky for us she had an insurance policy, and the house had a mortgage, my step father got all of that which was cool.. my bro/sister and i all split all the proceeds for the insurance policy as we were the named beneficiaries, so never an issue..
 
Verbal will or "complicated" as you so put it, amazingly avoiding that question that several people asked.

Written? Notarized? Anything?

If not, it looks pretty grim.
