Anyone ever have to battle a close family member over an inheritance?

Ok My dear Peeps heres the situation,My father died 5 years ago and left 1/2 (amongst other things)Of an 8plex apt building in New Orleans to My sister and I(The other half is owned by my uncle)For the last 5 years my sister and I have allowed my mother 100% of all rents(about 3200.00 per month before taxes)Because she needs the money(like I don't but whatever)There is only a verbal will my dying fathers request was for my mother to have the house ,and my sister and I the building(both are completely paid for)Well I have been pushing to sell the building for 2 years(its worth about 600k in which I am entitled to 1/4 or 150k)My uncle is a very wise investor and has made millions in real estate and talked me out of selling and instead wants to pull a second for 200k,we still own the building,iv'e got money in my pockets and the rents pay the note.Heres the problem:My mother obviously HATES this idea as it will take income from her(she already has plenty)And now she feels she is entitled to 50k of the 150 split.My uncle is taking the high road and if you guys follow my threads(I know ariel does)You know my mother is an alcoholic with a reckless lifestyle.I'm scratching my head right now because if lawyers are involved those scumbags are gonna rape me so im all out fucked right now.Sorry for the rant if you made it this far thanx 4 reading.HHC

tough situation, anyway you or your uncle can talk some sense into your mom? seems like it would be the best course of action.
 
i still shudder to myself over what my youngest bro & sis wanted to do after my Father went to heaven.

my Mother has instructions in her will for me to change the front door locks the moment she joins my Father.....Payback for the other kid's behavior.
 
I don't see why your mother has to know the intentions of the property. You/sister and undle own it. If you decide to sell, then sell, THEN tell your mother... oops, we sold it.

Why should she even be in on the discussion if she doesn't own it?

Is all this in writing? I mean is the building legally yours or will you bring a tape recorder to the court room with your father saying "It's yours..." before he died?
 
Do NOT fucking do it, not if you have a brain in your head.

1. Family fights over money are the ones that destroy the family, and whoever you think is on your side NOW will not be in the end.

2. If you don't care about point #1, I take it from what you said there is no written will and everything is basically verbal. Legally your ain't entitled to shit, only his wife is (seriously, depending on whose name is on the deeds. Children are not legally entitled to any inheritance if there is a surviving spouse). Lawyers will drag it out and everything will get sucked up in legal fees. You end up with zero cash, zero assets, and the family hates each other.

I watched this happen between my aunts and uncles when my grandparents died. It was ugly as sin, took more than a decade to resolve, and in the end the only people who got shit were the lawyers.

Its kinda complicated,Only this year i have been coherent enough(Im a recovering addict as most know)to really understand whats going on my sister is fuckin worse than me .All of our intentions were to let my mother have extra money now we need it and the free rides over and the shit hits the fan.
