I did some reading last night on this. It seems that rape is hard to prove. Rape means “the slightest penetration”. To prove this the DA usually needs a pregnancy after the fact. What I mean by after the fact is that if time has passed before the accusation there can be no vitulo kit (rape kit) for sample collection. A DA will usually not try a case he cannot win.
If this guy was into little boys then the laws of deviant sexual intercourse would apply. Where the level of proof is not as restrictive. It would mean that if the mouth or anus were touched then this would apply. I don’t remember penetration being a factor.
Back in 1992 when working in the projects we were doing a vertical patrol. Came across a semi open door. Looked in and there was a full-grown man banging some little boy on a couch. This was in plain view. When we brought him down in cuffs there was silence with every cop. No one said a word to him or each other. You can sense the tension that everyone there wanted to kill this guy.
