They use language like "unwelcome contact" and "hostile working environment" and then let a bunch of judges decide what the lawmakers meant. Its a pathetic way to push-off responsibility for writing good legislation away from lawmakers and toward the judiciary.
I'd love to see a constitutional amendment that automatically struck-down any law that wasn't quantifiable and/or fully spelled-out.
And yes, you can be beyond fucked for touching a woman on the elbow. It can *definately* be considered harassment based on court rulings. And the fun thing is, we taxpayers get to pay for the Department of Labor / Equal Employment Opportunity Commission investigation that ensues. Fun times.
