Kayne----The PLIFTER issue is distinguishable from the PRESENT issue b/c Plifter is only having his rights limited on a disussion board, the molester is having his right of free speech limited in a much broader sense---he' s having it limited period.
 
I want to thrown another variable into this story. He was on probation for another felony. Does this excuse him from constitutional rights and should it be considered in his punishment.

This man was convicted for writing down activities that are illegal, even though they were fictitious?

Hmmmm, what Satanic Goatslayer writes on this board would also be "Illegal" and "obscene", and a lot of us (myself included) had a jolly good laugh at it, as it is fictitious.

In fact a lot of us may have written about things that are actually illegal to do.

I wonder how long it will be until we can be convicted for "thinking" about illegal activities. Outlawing and policing people's thoughts is the final frontier... imagine we could lock up all those sickos just because what they think is illegal, ummm actually... remember what YOU were thinking about last time you jerked off? That would probably qualify as obscene, too and so would be illegal... I think it's time to put us all in jail.

I have to agree with RyanH (probably the only time this will ever happen :D ). You should not and can not be convicted of thinking the wrong thing. It's only wrong to do the wrong thing. This is dangerous territory they're treading on.
 
After reading that news clip I myself am pissed off...Fuck that shit. If he just wrote a fuckin journal, that should be his business...Yeah I hope he challenges the shit out this law. He basically was convicted for his thoughts. That sounds to me as if his free will was told to shut the fuck up.

I think if it were to get to the U.S. Supreme court his conviction would be overturned. I don't think it would even get that far to be honest.
 
Alright...If he was just writing down his thoughts and shit, that's ok! I haven't read about it at all, but do you really think he was just convicted for writing shit down?? I think not, the law does NOT work like that! He must have done something else. And if he did get convicted for "writing down his thoughts" he would NOT get 10 years, or anything near 10 years!

There must have been some other aspect to the case then just the journal!

Once again I have not even heard the story, just what you have told me. If someone wants to tell me where I can read the story, I'll read it!
