This is really such a hard question, because it is answerable on so many levels.
The machinations of passing the laws are handled by state legislatures, and the federal government through Congress. But I doubt that was what you meant.
The day to day responsibility lies with the elected leaders who pass the laws. The ultimate responsibility lies with the people, since power derives from the people.
Who benefits? Well, that's a tough one. This could be a long discussion. The chief beneficiaries of anti-drug legislation are
-pharmaceutical companies. They want you on drugs. Theirs. And they want to keep the competition illegal.
-corrections employees and police officers. More money in the budget means more cops, more money, more overtime, more "bad guys" to chase, more perceived viability, higher status in the community. (In related news, the FBI is hiring like mad post 9/11)
How to reverse them? It's simple. Information and action. Politicians respond to the voices they hear in the community: for example, some nimrod somewhere came out and said "If you're caught selling or using drugs on school grounds as an adult, we can give you 5 years".
And people came out and said "That person is really tough on crime. Yeah! Let's keep the drugs out of schools! We'll show them".
Elected leaders often need an "enemy" to keep power. Think about it - if everything was going "just peachy", why would you need to keep people in power? Bush has terrorism. John Kerry, to get power, has to paint this picture of the "horrors" of the Bush admin. But regardless of who wins, day to day life won't change a lot.
State and local politicians love to use crime as the "bad guy". never mind that the waron drugs has failed miserably. never mind that the US has more peple in prison than China. We need to be "tough on crime DAMMIT"
If people ever stopped and said, "Hey, um, this isn;t working", then maybe things might change. But a politician will never come out and say that. Politicians are like consultants - they look at your watch and tell you what time it is. We (voters) have to give them a mandate. Most people don't even know who their elected leaders are.
We're in deep shit.
