California officially out of money!!!!

The US is kind of a "blame not the child for the transgressions of the father" type of place. We decided long ago that anyone born on our soil would be an American. It isn't the kid's fault that the mother broke immigration laws. The bank robber mother could choose not to take the money. A child cant choose where he is born. That child (born on American soil, born into the American legacy, and all that patriotic mugawuga) is just as "American" as you and I and is not "illegal."

:cow:

and its not the taxpayers fault either.. can you please explain why we shouldnt deport both of them and charge the birth cost to the Mexican government?

dont obligate us to take care of someones kid because of some strange ethical delimna. most of us have our children to feed and take care of..

You can't deport a natural-born US citizen. Ever.
Taxpayers have to pay for poor US citizens of Mexican decent just like they have to pay for the southern white trailer park poors. A natural born citizen, is a natural born citizen. It seems you might have a stronger argument for welfare reform than immigration reform, as people who are born here are not immigrants.
This isn't a moral dilemma, it is basic statutory and constitutional law.

i hate this fucking state...im just tryin to convince my gf that CA sucks nutsack...worst place in the US along with Jersey...Ill be outta here on the first thing smokin if i can convince her to move out or if unforseen circumstances arrive...

Never say can't. All we need is a few supreme court justices who see the constitution as a living document. We don't mind to play that game when it comes to a whole slew of "progressive" (Read: liberal) ideas, so maybe they can try it with a conservative principle this time.

Besides, these 13 million illegal aliens are occupiers. Their children born on our soil don't count.

Thank God we can deport illegal's born in Canada. Must be the reason why dump their turd on US soils lol

I hope you're being facetious and actually know the difference between a hostile occupation (where your territory has been placed under the authority and control of a hostile army - think France in WWII) and merely having "unwanted" people living and working in your country.

Let's reflect a moment...

1) There are a non-trivial number of them in our country (13 million or more)

2) They have entered the country illegally and remain here illegally.

3) A small (but significant) portion of them are involved in other forms of illegal trafficing.

4) A small (but significant -- and growing) portion of them are involved in illegal gang activities and violence toward US citizens.

If you don't like "occupiers" what term should we use? "Tourists", maybe?

P.S. And don't use France in WWII as an example. The French would let anyone do anything as long as they don't have to fight.

"Hostile Occupation" is a term of art. Laypersons see the term as one that is open to various interpretations, but it has a very specific and set meaning in the legal world.

Your attempt to classify them as "hostile alien occupiers" is flawed in that you're missing the "military" element, and the "exhibiting authority and control over the territory" element. In order for them to be appropriately classified as hostile alien occupiers, they would actually have to forcefully usurp the government, or we'd have to come to some agreement with them where they are granted "authority and control" over a US territory (like France did with Germany).

The correct term is not tourists, obviously, as "tourists" are individuals admitted to the US as a nonimmigrant visitor for pleasure, pursuant to INA § 101(a)(15)(B).

The term previously preferred was "illegal aliens," but that has fallen out of favor with many in the legal world because it is ambiguous and imprecise. It does not, for example, speak to whether the individual is one who entered the country without authorization, or one who entered the country lawfully but then overstayed. It also causes problems, because some people who are considered "illegal aliens" might not currently have the proper documentation, but might be eligible for asylum or other legal remedies.

My books use the term "undocumented migrant." That works for me.

You can call them whatever you want. But if you want to get in a legal discussion, you have to use certain words in certain ways. Lawyers are quite picky about that stuff.
