California officially out of money!!!!

But shouldn't be, if the act that got the mother into the US in the first place was illegal.

It should be like robbing a bank and giving the money to your mother. Even if the money is in her account and she hasn't broken a single law, the money still isn't hers if you get caught.

The US is kind of a "blame not the child for the transgressions of the father" type of place. We decided long ago that anyone born on our soil would be an American. It isn't the kid's fault that the mother broke immigration laws. The bank robber mother could choose not to take the money. A child cant choose where he is born. That child (born on American soil, born into the American legacy, and all that patriotic mugawuga) is just as "American" as you and I and is not "illegal."

If the baby is born here, the baby is a US citizen (and not an illegal mexican baby).

If you're a us citizen, do you have a consitutional right to healthcare?

Have a kid in mexico and they'll cuff you to the bed til relatives cough up moolah for the bill.

It's a ridiculous policy. If the parents are here illegally, they and their children should be sent back to their country of origin. I do want to make it easier for legitimate foreigners to become citizens, but if you're here illegally, breaking the law needs to have consequences.

What is ridiculous? That we have birthright citizenship?
If the child is born here, the US is its country of origin.
I think there would be some big 14th Amendment issues with denying citizenship to people born here.

Then let's look at an extreme example.

If a female terrorist wanted in their home country for extradition hijacked an airplane and she delivered a baby moments after the plane entered US airspace, you'd be all for the baby being given citizenship?

If you're illegal and you show up at a hospital to pop out a baby and demand $50k for state of the art healthcare for your kid...

Your kid stays, taxpayers pay for the deliver, INS picks you up the next day.

Of course that is not politcally correct. It'll lead to mexican women delivering in back alleyways. It'll lead to wah wah stories of US deporting new moms, separating them from their poor little babies. Waaaaaaahhhhhhhhhhhhh!!

Far easier for Joe and Jane US Taxpayer to just fork over the $50k for the delivery, welfare for the mom, healthcare for the kid, etc. etc. and just look the other way. And you wonder why we're broke. Coincidence??? Nahh!!!! Keep that head in the rock people, enjoy your recession bitches. Guess what, it's gonna get worse - Ha!

The two exceptions to the natural born rule are children born to foreign diplomats and children born of alien enemies in hostile occupation. The logic behind these exceptions is that the diplomat and the enemy alien occupier are not subject to the jurisdiction of the US. The Vienna Convention of Diplomatic Relations says that diplomats aren't subject to the jurisdiction of the state in which they are performing their diplomatic duties - so you cant prosecute them, etc. The enemy occupier would be under the jurisdiction of the occupying nation, not that of the US.
It could be argued that the mother in your hypo is an alien enemy in hostile occupation, but there are holes in that argument, as the hijacked plane wouldn't constitute a full on occupation, only an attack/invasion. And this isn't a government sanctioned invasion, just one by a lone crazy, and I'm pretty sure that she will be under the jurisdiction of the US, prosecuted, etc. if and when she lands.
Interesting question though.
I think, technically, the kid would be born on us "soil" (or in this case air) and would be subject to the jurisdiction of the US. So yes, the baby should be granted US citizenship.
This would be a cool hypo for a law school exam. Way more information than you wanted, I'm sure.

We should argue that 13M Mexican illegal immigrants on our soil constitutes a bona fide occupation. Isn't that what an occupation is in the first place? A bunch of people on your own soil that you can't remove?
