Texas State Lawmaker Opposing Deadly Force Bill Shoots Would-Be Thief

HOUSTON — A state lawmaker who opposed a bill giving Texans stronger right to defend themselves with deadly force pulled a gun and shot a man he says was trying to steal copper wiring from a construction site, police said Monday.

Rep. Borris Miles told police he was fixing a leak on the second floor of the Houston house he's building Sunday night when he heard a noise downstairs and saw two men trying to steal the copper. After Miles confronted the pair, one of the men threw a pocketknife at him, Houston Police spokesman Victor Senties.

Miles, a former law enforcement officer, shot the man in the left leg, police said. The wounded suspect was being treated at a Houston hospital. Police were trying to identify the other suspect.

Charges of aggravated robbery are pending against the wounded suspect, Senties said.

Police said Miles, who is in his freshman term, is licensed to carry a concealed weapon. No charges have been filed against Miles, Senties said.

Miles, a Democrat, voted against a bill that gives Texans stronger legal right to defend themselves with deadly force in their homes, vehicles, and workplaces. The so-called "castle doctrine," passed by the Legislature this year, states that a person has no duty to retreat from an intruder before using deadly force. The law goes into effect Sept. 1.

I don't see it as liberalism vs. conservatism...........cause in actuality there's alot of these right wing fundamentalist conservatives that are now pretty much having to come out against the death penalty to "keep in line" with their "culture of life" views.........so you watch, slowly the right will reverse itself on these issues. I'm a liberal and I've ALWAYS been for the "correct" assessment of the death penalty and the ability of every mother fucker on this planet to protect what's his when somebody invariably comes for it.

Shooting someone in the leg is obviously not purposely deadly force.

I don't see the irony.

The guy seems consistent to me.

Altough - I don't think your average person can be expected to be able to make such decisions in the heat of a moment. If you have to discharge your firearm at someone - no one should pick apart where you shot them.

Fuck them.

In 2005, Fla updated the castle doctrine to include not just inside of the home, but to also include vehicles and even your person or someone elses if you feel threatened.

The Florida "Castle Doctrine" law basically does three things:

One: It establishes, in law, the presumption that a criminal who forcibly enters or intrudes into your home or occupied vehicle is there to cause death or great bodily harm, therefore a person may use any manner of force, including deadly force, against that person.

Two: It removes the "duty to retreat" if you are attacked in any place you have a right to be. You no longer have to turn your back on a criminal and try to run when attacked. Instead, you may stand your ground and fight back, meeting force with force, including deadly force, if you reasonably believe it is necessary to prevent death or great bodily harm to yourself or others. [This is an American right repeatedly recognized in Supreme Court gun cases.]

Three: It provides that persons using force authorized by law shall not be prosecuted for using such force.

It also prohibits criminals and their families from suing victims for injuring or killing the criminals who have attacked them.

In short, it gives rights back to law-abiding people and forces judges and prosecutors who are prone to coddling criminals to instead focus on protecting victims.

You do realize that in your state you couldn't shoot someone in self defense outside of your home, period, until a month ago?
 
I would argue that simply firing the gun in his direction would be found to be use of deadly force in a courtroom.
Regardless if where he hit him or maybe even if he missed.

Deadly force is a level of force which is inherently likely to cause death or great bodily injury. Firearms, bladed weapons, explosives, and vehicles are among those weapons the use of which is considered deadly force.
 
When I took the course awhile back to get my concealed weapons permit here in Oregon they had a lawyer come in and talk for awhile. He said make sure of two things if you ever have to use your gun in self defense. One, make sure the individual is inside your home. And two, make sure he/she is dead. Otherwise you will be financially devastated when they sue you, and possibly do time.
 
The INSIDE of your home restriction is relevant to most states in the US..
aka Castle Doctrine. You must retreat if you are able to, unless inside your home.

Some states are now removing that restriction to allow you to shoot anyone anywhere when you fear for your life or safety, or someone elses even.

No wonder we hear of horrific stories daily on the news. The geniuses passing laws only hurt the ones who abide by them.
