Is a felony really that bad???

One of my boys back home just got busted with X. He's all stressed out about having a felony record because he makes good grades in college, and can be an asset to any company. Since I've never been faced with such a problem, I would like to know if any of you may have some insight I could give him. He's really worried about this job thing.

What degree of felony was it? As long as he hasn't been in any serious trouble before he will probably get deferred ajudication. So the felony won't go on his record if he completes everything of his probation and doesn't get in any trouble. I've known lots of people (including myself) that have been busted for a felony and come out alright. As long as he stays out of trouble while on proby. This will definately cost him some $$$ though.

Actually, he said they were going to adjuticate him guilty because he's not a hometown boy. I think that's a pretty fucked up situation.

Do you know if you can get deferred adjutication on a 1st degree possesion with intent?

He should be alright if the felony doesn't go on his record. I know it wouldn't be good if it goes on his record though. Have to check yes to felony on job application, can't do a job that requires any kind of license, and you can't have guns. That's what would kill me because I love to hunt. Im sure there are more things you can't do with a felony.

Well, with a felony, you cannot legally own a gun. Ever.

You cannot vote. Ever.

Your entry/exit from this country may be hard to do. I do not know if they let felons possess passports. So, he may only be able to go to Mexico and Canada.

very rarely will the system attempt to destroy you for possession.

possession with INTENT TO SELL is an entirely different story. the stakes are raised considerably.

Possession is normally a "D" felony, and can be plead down to an "A" misdemeanor.

Possession with intent is a "B" (think) felony, and there is little hope....

BTW do not believe the sentencing guidelines... they are never followed...

NATASAN, for a person to not be allowed to live in a certain section of town because of a felony conviction is against the law!The fair housing people would have a field day with that and if a convicted CHILD MOLESTER can move into anyplace they want then someone who was found with "X" IS AN ANGEL AND NOBODY WOULD KNOW THEIR BUSINESS ANYWAY.The guy would sue the hell out of them for discrimination and I think he would win. In NYC some of the very nice upper eastside million dollar apartments a person may be able to buy because he or she has the money , but the homeowners association is going to have to vote to see if he or she can be a member/resident????WTF, I thought I had seen everything, but there you go. The thing about the association mostly occurs when high profile people like movie stars, or rock stars are trying to move in and the people who already live there are worried that the paparazzi,news etc... will turn their private domain into a prision so they vote!

TELL THAT TO MY BROTHER WHO HAS A POSSESION CHARGE AND HIS SENTENCING GUIDELINE WAS 20-40 YEARS. HE GOT 30. LUCKILY FOR US, THE STATE FUCKED UP A BUNCH OF SHIT AND DID SHIT ILLEGALLY SO HIS CONVICTION WAS OVERTURNED. HE IS NOW WAITING ON A NEW COURT DATE AND WILL MOST LIKELY GET OUT SOON.

He may also be dealing with "mandatory minimum sentencing". That seems to be the legislative knee jerk reaction to the new popularity of "x".

The voting and gun thing is true but usually there is judicial flexibility - I know a guy that got busted for possession/intent - did 6 months, and can neither vote nor own a gun for 10 years, at whcih point there will be a hearing to determine the status of that.

I think the job thing will fuck him up, but I'm not sure. I guess if he completes his college education he will be alright. What do you guys think? Will it still hold him up? Or will he be able to make a descent living like everyone else?

I forgot to say something else. When the court adjudicates someone guilty, there is no way to get it expunged. The only thing you can get is a pardon from the governor and even a pardon doesn't take the record away. All it does is say that the state forgives you of the crime and they can't hold it against you if you get in trouble again.
