They could say that they were still evidence gathering.
They technically don't have to bust you right then. They really don't have to bust you at all. Sort of like not paying a parking ticket. The deadline day passes and you don't pay, they don't run to your home and bust you then.
When the average steroid user (not dealer or remailer) gets pinched it is usually for a couple of reasons.
1 - they are hoping to flip them and get evidence going towards bigger fish. If they are trying to fry a big guy and can't seem to get enough to nail him down, then they will bust a smaller guy and hope he squeals. If not, they bust another smaller guy and then another and another.
2 - the user they bust is someone that they probably need to get their hands on for other reasons. A controlled delivery gurantees them access to that person's home. Which they may need to investigate rec drugs, murder (remember THAT source that was taken down for murder?), distribution info, etc..
3 - the user is generally someone that they can't stand and pissed them off someway. It could be someone that is a loudmouth, or they have a personal vendetta against, or just a typical meathead asshole. getting multiple packages all the time, fronting out flash cars, being a player on the party scene (I know one guy busted for roids for no other reason than he hung out in the South Beach party and they were looking for a key player to help break up the X and K sales down there.
Once you take a controlled delivery, that's it. They can bust you anytime they want. Technically you would want them to wait as long as possible and not bust you right away. They could nail a bigger fish down the road and then deem it not worth the time and effort to take you down. If they can get all they want out of one person, there isn't a need to parade 2-3 other small time users through the show. Besides they figure eventually karma will get you anyway in a different form. You get an absess, you get scammed (that'll teach you buy drugs you fool), your wife find outs, etc.. they know you will eventually get yours in the end and there is no reason to heap shit on you unnecessary if they are already in the end zone with other evidence.
In South FL, much like CA, the physique culture is dominant. Anytime you live in a popular destination with warm weather year around where shorts and tank tops are everyday attire, where you can swim in the ocean even in Febuary and get a sunburn, well you know roid use is going to be wide spread. I have personally known MANY people to get busted down here. For roids and other shit.
If you are hell bound and determined to get arrested, here is some general advice...
Pick your location to get busted. Hope you are renting your home. Otherwise that house/condo can be seized. Better not get busted at a friend/relatives house either for this same reason.
You never get busted for just roids. You end up with at least half a dozen charges. Possession, felony use of US mail service, distribution (based on what they determine is too much for personal use), if you are at the post office, you get illegal possession on federal property - sounds like a redundant charge to the original possession one, but trust me, they throw that on there, your vehicle is seized, you better pray that post office is not in the vicinity of a school zone, intimidation of federal employees - for those of you who insist on walking around with imaginary lat syndrome in effect and the hardcore Animal Pack scowl/stare on your face.. and this is not even counting what they find when they go through your personal effects.
If you do get busted and it is your first time, don't fuck around with a high price attorney. You are going to be offered the same shit you would get from a public defender. First Offender deal is available for anyone. No attorney can "get" you that, so don't fall for that line about paying thousands for someone to get you that special deal because it is already available to you. If it isn't your first felony bust, then consider an attorney. Or at least a psychiatrist to help you figure out why your ass didn't stay out of trouble in the first place after the first charge.
Also, if busted even for a personal amount, you may want to consider actually telling them that you don't use drugs, but were just going to sale them. This sounds like terrible advice but consider what happened to two different guys at my gym. (you can do a search on my name from years ago when I first posted this with newspaper links in greater details)
Dude 1 - busted with about 20 different vials of roids, multiple bottles of viagra, vicodens, xanax, hydrocodon cough syrup.
His charges were :
Possession
Distribution
His sentencing was :
5 years probation
$3500 fine
200 hours community service
He had to physically check in with probation officer each month and take a drug test. After the first year, he had already paid his fine, finished his community service they put him on Administrative Probation (I think that is the term) and allowed him to just phone in and leave a voice mail each month for the next four years.
Dude 2 - Got busted with 4 amps of Sust in his pocket. Basically what happened was he was in the wrong place at the wrong time and got his ass detained and frisked where they found it.
His charges were :
Possession
Give false address. Which technically he didn't do, they asked him where he lived and he gave them his address - which was his real one where he had been living over a year, however when they looked at his license, he still had his old address on his license and they charged him with giving false information. This goes to show how they try to increase the charges.
His sentencing :
3 years probation
$2000 fine
200 hours community service
Drug test monthly at probationers office
He used a public defender under the First Offender plea.
Now because he told the cops this was for his own use, trying to get it down to personal use level in hopes they would let him walk, he also had to :
Go to Narcotics Anonymous (because it required a syringe for administration) twice a week for 18 months.
Go to 26 sessions of psychic evaluation / drug counseling
Go to 26 sessions (once a week for 6 months) of Abuse and Recovery treatment which he had to pay $300 per month in fees for.
He also paid $4000 for a private attorney which got him... guess what? First Offender plea.
Now you add it up
$4000 attorney
$2000 fine
$1800 treatment fees
3 days a week (2 for NA meetings, 1 for the Abuse/Recovery meetings) where he could not plan to do anything those evenings like work out or be with his family because he had to drive across town and attend meetings
The weekends that he missed catching up on his sleep, having fun, watching sports, etc.. because he had to do community service.
So which one got the better bargain.
Moral here is, don't get busted. Second moral is, if you do, get busted smart.
