Am I Going To Jail!

OK HERE IS THE STORY. JUST TONIGHT ME AND SOME OF MY FRIENDS WERE SMOKING SOME BUD. WE WERE INSIDE A CAR OUTSIDE A BAR. THE POLICE ROLLED UP AND SERCHED THE CAR. I GOT BUSTED WITH POSSESSION UNDER 35 GRAMS AND PARAFELINA. THESE ARE BOTH CITY CHARGES SINCE I HAVE NEVER BEEN ARRESTED FOR DRUGS BEFORE. THE POLICE TOLD ME THAT THE CITY CHARGE WILL NOT GO ON MY RECORD. I GOT BUSTED IN MISSOURI. I AM ON MISDEMANOR PROBATION IN ILLINOIS FOR 1 YEAR. THEY ARE HOLDING 58 DAYS JAIL TIME OVER MY HEAD IF I SCREW UP. MY QUESTIONS ARE. SHOULD I TELL MY PO ABOUT GETTING ARRESTED IN MISSOURI FOR THESE NEW CHARGES. SINCE I WAS ARRESTED IN MISSOURI AND I AM ON PROBATION IN ILLINOIS SOMEONE TOLD ME THE ONLY WAY MY PO WOULD FIND OUT IS IF IT WAS IN THE PAPER. SHOULD I TELL MY PO?
 
I think you should go to school instead of smoking bud. I have no idea what the hell you are trying to say.

Thats a hard one to answer guy. Maybe if you have a friend or know someone who could ask a lawyer you could get an idea of what to do. My thoughts are you might be able to get away with it but if ya don't your double screwed for not saying anything. Get some legal advice.
 
If its a city charge then its like a speeding ticket so you should be fine. I was on probation got caught with just under a ounce and just had to pay the fine, notheing else ever came of it.

Dude. I would say that the chances of them finding out about your probation in Illonois(if your still on Probation that is)is 95%. I wouldn't tell them either way, but if you are giving a monthly report to the Probation office in IL, and you lie about not being in any trouble while on probation, then they might go harder on you. EITHER way, if IL finds out about the Possesion charge, you ARE going to have to go back there for a revocation of probation hearing that will determine weather or not you get more probation, or jail. Sorry, but thats how it works bro. Iwould start talking to a lawyer about what your next move should be.

guys, put yourself in his position. I would be freaking out too! I woulndt post my shit on the chat board because most of the responses are totally BS. I would post here, where I know a lot of bro's.
 
I've been on probation before...you were stupid to go anywhere near anything illegal while on it. I was a juvie when that happened but they wouldn't let us leave the State while on it (without special permission). I'm surprised that they let adults roam around while on probation.

Funny how you feel so strongly about him posting this in the wrong area(which I admit he did), but you managed to read the whole way down to YMK's response & THEN posted your own! If you dont give a fuck, then why did you read the guys post in the first place, not to mention the responses to it? 58 days ain't as bad as a felony that hangs over your head for the rest of your life. Just be glad it was some misdemeanor shit, get a lawyer and do 2/3 time get out in 6 wks. and hit up the gear. County jail isn't fun but it ain't American History X style.
I would not volunteer any info, better to keep shut up and let your lawyer do the talking. Sux though b/c that lawyer money could have been a fat cycle and that ounce is worth at least a couple bottles of Test or something
 
That sucks, I'm sorry to hear. Glad that I live in BC where pot is practically decriminalized. Most of the time the cops leave you alone, but if a cop does catch you with some he'll just take it away and chuck it. Pretty neat :)

To answer your question, no I wouldn't tell my PO. 58 days of jails sounds rough.
 
They will probably make a deal with you....try to get you to turn x amount of people in for freedom. that decision is up to you....

Speaking as a lawyer.... i can tell you absolutely nothing about this. I really don't know too much about probation violations. It also depends how much you trust your PO. My best advice would be to STOP BREAKING THE LAW! :mad:

Hey, I got pulled over for running a red light this weekend... small penalty, 75 bucks... and I don't think my insurance will like it too much.

DID YOU GET A TRAVEL PASS TO LEAVE THE STATE? ALSO DID THE COP MENTION YOU WERE ON PROBATION SINCE HIS COMPUTER SHOULD HAVE TOLD HIM SO.IF YOUR PO NOTIFIES YOU WITHIN THE NEXT WEEK YOU WILL KNOW HE KNOWS. CALL HIM MONDAY TO ASK A STUPID QUESTION YOU MAKE UP. IF HE MENTIONS ANYTHING ABOUT COMING INTO HIS OFFICE HE KNOWS. IF HE DOES A HOME VISIT SOON HE KNOWS. IF NEITHER OCCUR HE DOES NOT KNOW.
 
The chances of getting found out are pretty good.

1. the paper
2. PO runs a CCH
3. You test positive on a UA

Not to mention a couple of other violations. Did you leave the State with permission? Failure to report any 'contact" with law enforcement is ususally a violation. Do the give you UAs. If so, weed stays in your system about 30 days. As a prosecutor, I will give abreak to someone who comes clean without getting caught first. I would tell your PO and see if they would"help" you with your"problem". A little contrition will go a long way and probably keep you out of jail.

This is from a guy who prosecutes folks like you for a job.

YEAH THE ATTORNEY IS RIGHT. BEFORE YOU GET A DISCHARGE FROM PROBATION THE PO USUALLY RUNS A CHECK TO MAKE SURE YOU HAVE INCURRED NO NEW ARRESTS. SO THESE WOULD BE ON THERE. WHAT I WOULD DO IS GO SIGN UP FOR COUNSELING FOR DRUG ADDICTION THEN TELL YOUR PO YOU HAVE A SUBSTANCE ABUSE PROBLEM, YOUR IN COUNSELING AND THEN TELL HIM THE TRUTH. BEING UP FRONT IS THE BEST. IF HE IS ANY GOOD HE WILL FIND OUT ABOUT IT EVENTUALLY. ALSO BRING YOUR MOM IN WITH YOU WHEN YOU TALK TO HIM SO HE WON'T HAVE YOU ARRESTED IT HELPS IF SHE YELLS AT YOU IN FRONT OF HIM. BUT IN ILLINOIS PO'S AREN'T CONSIDERED LAW ENFORCEMNT PEACE OFFICERS LIKE IN NEVADA SO HE CAN'T ARREST YOU I THINK. BUT THE LOCAL POLICE DEPT WILL FOR HIM.

I HAVE PERMISSION TO LEAVE THE STATE. I DO GIVE UA'S BUT I HAVE NOT SMOKED ANY WEED. I WAS JUST IN POSSESION OF IT AT THE TIME. I DON'T KNOW IF I SHOULD TELL MY PO OR NOT. MOST PEOPLE TELL ME NOT TO. WHAT SHOULD I DO?

Tough call. Those facts increase the chance they won't find out but if they do, you will probably get screwed. If you come clean, chances are pretty good they will simply modify your probation for some rehab, maybe a weekend in jail or extend your probation. Safe bet is to tell'em but the odds are reaonable they won't ever find out. This will be of no help but........TRY DOING WHAT IS RIGHT!

If you're PO hasn't contacted I would say shit because chances are they don't know about. PO aren't understanding people and what they don't know would hurt you. I was on probabtion and fucked up (DUI) and my PO never found out.

F/N DON'T GENERALIZE. I KNOW SOME PO'S THAT LET ANABOLICS STAY IN THE OFFENDERS HOUSE BECAUSE IT IS NOT HURTING ANYONE. I KNOW SOME PO'S THAT COULD EASILY GO INTO THESE HOUSE ON A RAID AND ARREST ALL THE PEOPLE BUT THEY DON'T. PO'S ARE LIKE ANYONE ELSE SOME COOL SOME NOT. PLUS IN NEVADA IT SUCKS THOUGH CAUSE THEY ARE STATE COPS ALONG WITH BEING PO/LAWYER.
 
I'm just going by my experience and those of people I know. My PO was cool but one month when I was short on cash and was gonna be 2 weeks late with my payment she turned into a total bitch on me. But I'll say some may be cool. Mine wasn't though.
