hey guys. just had to post in here since my agency has done absolute shit for me....

no one has even looked at my car yet. I've been getting some bullshit about my agent being on vacation the past couple of weeks and his secretary told me she would take care of everything. They never assigned another agent or got anyone else to help me. Then my agents secretary told me a few days ago that I needed to contact the ladys agency and give a statement..... so I did. My agents secretary told me if i gave nationwide a statement it wouldn't matter.... wtf

The ladys agent told me she didn't even know if I had insurance and that my agency hadn't contacted them yet.

She also told me I was going to have to pay for my car sitting in the junk yard. wtf...

After I gave her my statement she told me that the kind lady that hit me told them that I ran through the red light and it was my fault. The police report says it was her fault and she was cited for it. She outright lied to them. They aren't even claiming liability when it clearly states it was her fault.

They also threw me a bunch of curveball questions to try and catch me offguard. like asking me if I was going north or south when I was going east on a one way street.

They said they still don't have a copy of the police report and its my job to give them it. good job nationwide.... fucking idiots.

and when I got super pissed a week ago and told my mom I was going to contact the higher ups of the company she started cussing at me since she's had this agent for 20 years. "they'll drop me or raise my rates if you complain about him" she says. But it's been two weeks and the guy hasn't even contacted me yet. His vacation has to be over. And if he doesn't call me back tomorrow I'm going to raise some hell.

God this sucks.....

oh yeah, and also this is the second year in a row that someone has hit me, gotten cited by the police, and then gave them a statement saying it was my fault. on the same fucking day too.

Agreed. My dad does that type of law for a living & I worked for him & insurance companies are assholes. It's not too late to lawyer up you know.
 
You shouldn't have to do shit due to subrogation. Tell the company you will contact the state insurance commissioner if they don't sort the shit out on their own.

it's easy bro.. call an attorney will not cost you a dime, don't make any more statements to anyone..

and good luck.. and for gods sake do not go back to work, and start seeing a chiropractor and getting a message 2x week.. (advice from an attorney)
 
I kinda echo the lawyer poasts. At the very least, you could talk to one for free and see if you have a case or if there's anything substantive they can do for you. You could then find out if this kinda runaround the insurance company is giving you is allowed by statutes or whatever.

Giving pertinent info like police reports will be your responsibility, though, as will be contacting the necessary people. They won't do your work for you. If you want to file a claim, *you* need to provide the info. Remember, they're a business. Their job is to make sure you aren't trying to steal their monies, so don't take it personally when they 'throw curveballs'. You trying to get insurance money and files claims is nothing more then a business transaction; treat it as such.

Get your 30 day car rental, enjoy it, wait for the claims adjjuster to look at your car and write you a check. That's it. If they want to go after the other lady's insurance - that's their job not yours.

They didnt fight me for shit when I hit someone recently. One call to my agent and that was it. Everyone called me and took care of me from then. Its state farm if you care to know, and ive paid them a shitton of premiums over a couple decades.
 
Insurance companies don't make money by handing out checks. Odds are you took it in the ass and didn't complain.

my agent isn't even around. i'm making the drive to his office tomorrow. if he's not in i'll talk to his secretary. If she won't help i'm complaining to corporate and i'm going to get on my own policy later on.

the lady who hit me's agent told me it was my job to supply them with the police report. i know thats bullshit.

the claims adjuster gets back from vacation tomorrow. but the ladys agent told me they weren't going to claim liability and that they wanted me to admit it. that's bullshit and the police report says she ran the light and got cited.

they also told me they didn't even know i had an agent and that nationwide hasn't even talked to them. which means the secretary or the lady has been lying to me this whole time (one of them did). I'm going to consult a lawyer tomorrow and get my knee checked out by my family doc.
 
Probably threatening to get a lawyer would speed things up a bit, and definitely you need to start writing down dates, names, and times of phonecalls. You also might be well advised to start writing letters and sending by certified mail. That in itself will get them MOVING. Indeed you're getting the runaround, and you should have had a check for the damage in a few days from the accident, if there wasn't a dispute as to the fault, and also if you and the other party have valid insurance. The problem with getting a lawyer involved, is that there isn't enough money in just property damage to make it worth their time (usually a lawyer is worth $100-$200/hr), and the only way they're going to get paid is if you were hurt BAD, (or they lie for you that you were). That's why I don't think it's a good moral choice, as evidently your Dad agrees. Sure you could go fake a lifelong injury and get $50K or $100K, and if you're a good person, you'll need that money later in life for sleeping pills when the guilty conscience catches up with you.

With all that said, a lawyer IS a last resort that you can use, but I hope you get some better luck before that has to happen...

if my knee is permanently fucked up, I will sue her. If not, probably not.

but i'm still pissed off the scumbag almost killed me, didn't even ask if i was alright or say they were sorry, got cited, had a kid in the car when running the light multiple seconds after it was red and speeding, and then lied to her agency and tried to blame me when the police report says its her fault.

my dad told me the lawyer thing was a last resort. apparently early in the morning today my mom decided to call her agency without telling me again and screwed up things even more. she even agreed with the agency and said the claim not getting through quicker was my fault, not theirs.

i wish she would fucking listen to me when i say to leave my business the hell alone. i'm 21 years old and i'm sick and tired of her fucking with my shit, even after i tell her not to.
 
Im with nationwide and never had any problems at all when i deal with them.. ive never neard of having "your own agent" with nationwide, i just call, talk to a random claim adjustor, and they take care of everything, even when it was my fault.

and i believe they are still the cheapest rates out there.
 
my agents secretary and my agent both haven't called me back today. My mom was bitching at me to talk to the lady who hit me's agent one more time so I picked up her call today. My agents secretary sent her the police report again today which states that the person who hit me got cited for running a redlight and was in fault. her agent told me that they were in no way going to claim liability and that they believed the police report was wrong and it was a she said he said thing. she then told me that she believed I should claim liability (wtf). she then asked me for the phone number of the witness who saw the accident and told me it was my job to give them the number.

I told them to handle the rest by talking to my agent and hung up. i'm not going to talk to them again no matter what the hell my mom does. My dad told me to rest easy and let the agents battle it out. I have no way of even consulting an attorney since I don't know any and can't even get a ride right now to any office.

I told my mom that if this agent didn't get me a rental car or have this shit handled in ten days from now, that i will go to corporate.

man this sucks....

Dude, I've been with Allstate my entire life, they are all over shit like this instantly, they take care of you, it doesn't matter who you are or how old you are or even if you are at fault.

Nah, you're right. You just have to realize since i'm under my moms policy, I can't get her to stay away from my shit. She'll go behind my back and talk to the woman's agency, and she talked about my injuries with them and shit.

after this i'm getting my own policy from an insurance company. fuck this.
i already pay for everything but that myself.
 
BTW, you're entitled to the money for a rental car from Day 1. When your agent finally returns, you need to give him shit about how you've been inconvenienced without transportation for the past two weeks. This is really unacceptable how shabbily you've been treated.
 
You may be under your mom's policy, but I'm pretty sure you still have the right to sue whether your mom likes it or not, as you are the victim.

This thread has turned ugly, and it's up to Iggy as to what to do in the end. It sounds to me like he has a good character, and if he does have to get a lawyer, he will act in good faith and not go for what he doesn't feel he's due. The catch-22 about that is, the lawyers will all want to over-demand by about 1000%, as it's not worth the going rate for a lawyer to fool around with a damage claim of a few thousand dollars, or even $20,000.

If I were in his shoes, I'd sit down and write a letter to both insurance agents, with a copy (cc) to the State of (_______) insurance commissioner or whatever that state uses to enforce fair practices in insurance, and send the letters to the two agents via certified mail with return receipt. That letter should contain EVERYTHING, so as they can't say later that they didn't know what accident you're talking about, etc. It should have (date, time, and repeating all of the details of the accident), the police report, photos of damage, and copies of any receipts to date, and any estimates for repairs to the cars, along with what if any other costs you have, or will have to, cover. Add all that up, and figure in a little for time & effort you lost, and write that you demand that this be settled by (___) date, or you will refer the matter to an attorney.

Iggy, if you do that, and still nothing happens by the date you demanded, which could be whatever you want that sounds fair; maybe 10 days, you can go get a lawyer without a guilty conscience later, as long as you don't let the lawyer talk you into creating all kinds of fake injuries from impotence to sore toenails, and an unfair sum for pain & suffering. Also be sure to get this going before the statute of limitations expires, which in many states is 1 year from the date of the accident.

i called my lawyer today and he's going to call me back tomorrow.
he's a family friend charles, and he wouldn't do any of that.

I asked my agents secretary to let me talk to him and she said he was out again. I told her he hadn't called me back yet and I need to talk to him. I then told her i'm going to call corporate.

my parents were both wrong, yet I mistakenly listened to them when I should of just went with my own instinct. I predicted this would happen and it did. Next time i'll take matters in my own hands and ignore them.

What the lawyer wants is 1/3 of the settlement pay charles. I'm getting my knee checked out tomorrow again. hopefully it doesn't come back as anything too horrific.

thanks for the help charles. do you think I should just write the letter/email instead of calling corporate, or would you recommend doing both?

Apparently also, she didn't even show up at court and pay the $95 fee they gave her for running the redlight and nearly killing me (a smaller fee then two parking tickets I was given at osu last year). So there is a warrant for her now.

My adjuster told me yesterday I would finally get a rental car, but that I would have to pay for the difference (wtf). They told me they set it up at enterprise, but i went there and found out my adjuster accidentally set up a car for the person that hit me instead of me. They apologized and fixed it the next day (which is today). I have to pay $2.50 for 30 days unless the other agency takes liability. (which if they don't i'm taking someone to court).

if you have AAA or amex or something like that you can usually get upgraded on the rental (even though the ins company is paying for it)

Ugh, the HHR is just a Cobalt wagon. Nasty.

GM hired a stylist who used to work for Chrysler, he did the PT Cruiser for Chrysler then moved to GM and did the HHR. Someone should break his hand before he has a chance to strike again.

OMG, my oldest friend has one of those HHRs, blech. We went to the museum and she drove. I felt like I was shoulder to shoulder with her, but also like a little kid because I was sitting so low (and I'm tall).

Plus they look like old butcher delivery vans.
