texas DWI surcharge

My wife got a dwi last August before we were married in Texas. We just recently found out that she is supposed to be paying a $90 surcharge every month for the next 2 more years basically. She now lives with me in New Jersey and has gotten rid of her Texas license. Since the surcharge is just there to allow you to keep your license, does anyone know whether if we neglect to pay it her new license will be affected or her chance of renewing it? I sent a few emails to some Texas lawyers but have not received anything back yet.

Is that charge to the state or for high risk insurance?

I got arrested last year for dui and got off in court and now i get my liscense back but they charge you $500 at the dmv and then they charge you another 300 to take their safe driving class. It's almost like you got convicted.
 
Its a new law for texas, basically a way for them to charge you an extra fine without calling it a fine. It can range anywhere from 1000 to 2000 a year for 3 years. Its to the state.
 
The surcharge is for a number of traffic law violations including habitual violators, Driving While License Suspended, and DWI. The money goes to the state to help offset the budget shortfall two years ago. When you are convicted the state automatically assesses the fees. You may or may not be warned about these fees when if you plead guilty. If you fail to pay the fees, your DL is automatically suspended. I understand that DPS is allowing monthly payouts.
 
Wierd law, as the No child left behind...snicky Bush............there is anothe coming for people that not fluss the toilet..............

Am I correct she paid her initial fine (or time) and has no warrants outstanding? Hope yes.

Then try this .....
Go to your local NJ Sec of State and ask to see if there is anything in their system on her. I'm guessing no.

Then have her apply. If they want to see her Texas license, just say she lost it moving. They want her to have a license and drive. It helps pay the bills.

Now ... as for Texas. I'm guessing they will want their money forever and will be real pissy if she is stopped there. They'll find her in their data using name and birthdate. She will have to pay up someway.
 
Yea we finally got in touch with someone who was straight up with us in texas. She already got the nj license so we had to pay the surcharge once to lift the suspension. Basically they said nothing will happen if we dont pay now but someday they might not let her renew her license and we will have to pay the whole thing. So fuck it no big deal for now.
