Prostitution vs Pornography

Ok I was just thinking the other night about intricacies of the law and this popped into my head.

Prostitution is, in most areas of this country, illegal. However, as far as I know, pornography is not. So, the question comes... If you were to pick up a prostitute and bring a camcorder and pay the prostitute to make a porno with you then does the sex act become legal, because you are making a porno and it just happens to be with a prostitute?


I will disclaim that I am not nor will I consider doing this. I am just curious about the law as it applies in this area.

Laws aimed at preventing prostitution are messed up for the most part anyway. They never stop prostitution and mostly don't reduce it. They just fuck people up.

In any case laws are fishy in defining prostitution, you could always ask a prostitute for a massage, and if that in turn leads to sex - well you 'paid' for the massage.

The massage angle I had not considered, but I also hear about a "massage parlor" being busted as a brothel from time to time, so I imagine that doesn't exempt you always

I'm not sure if I could ever bring myself to have sex with a woman who gets paid for it, but the point of my post was - where exactly does paid sex start? If you take a girl out on date, buy her presents and then lay her...?

I agree. The line is and has always been very blurred for me. Which brings another question, do women who hold out on sex for a particular gift classify as prostitutes? My instincts say no, because for prostitution, in my mind, there has to be no emotional intrest/attachment, on the part of the would be prostitute.

i can't understand why the government won't legalize prostitution completely. enable brothels to be set up and regulated, which i'm sure would encourage more safe sex and less STDs, better protection for the dirty whores involved too. it's a lot more dangerous for them to be on the streets than it would be in a brothel.

plus, the brothels would be registered businesses and the road whores working in them would be employees. we know what that means....they'd pay taxes. so the government would profit more in tax money generated than they do when they bust illegial brothels or arrest hookers on the street and they pay their fines. as long as they were fair and taxed them the same as any other business, things would be "good" for everyone.

Well, I agree about it being safer for the prostitutes, if legalized, and the government would get taxes from it. In fact, I've heard that the Bunny Ranch, outside of Las Vegas, has a retirement plan for its women. In addition to that, you ever hear of the prices they charge? They are outrageous, but I guess they are in a very flooded market so they can charge whatever they want. If prostitution were leagalized then the market would no longer be flooded. Supply and demand...

laws never work if they drive an industry underground.. regulation, taxation and legalization would do much more for the safety of sex industry workers but that'll never happen while public policy is dictated by religious pressure groups.

street whores are disgusting and should definitely be illegal but brothels aren't such a problem.

Don't worry tweakle, public policy will continue, imho, to get increasingly secular. As time passes the public is getting further away from religiously based policy. At least that is how it seems to me.

I think that morality is drifting further away from the classic "religious" morality. If this is the case, then public policy will follow. And about the whole Stern thing that is Bullshit as well as the whole banning smoking in PRIVATE areas like restraunts. That is crazy!

In most of the country making porn is illegal but possessing it is not. One place in particular is Van Nuys California where it is legal to make it so if you are going to try to use this defense I would start off there. The massage thing has worked for some in the past but typically if you end up with a hooker then you don't end up at the police station anyway. It is the time that you end up soliciting a cop that gets you cuffed. They have to legally get you to say that you are going to pay her to have sex with you. You incriminate yourself by agreeing to pay a certain price for a certain sexual act. I doubt that you would get a cop to agree to shoot a porn film with you. But if you do send me a copy.

Thanks man. The hitch I saw was in that I didn't know if producing pornography was illegal in most places. You cleared that up.

Agian, I will state that this was only a curiosity about the law, rather than an attempt to find a way to pay for sex legally. Never have paid for it and honestly I can't see myself ever paying for it.
