My new car is totaled....

So puds, i had to stop into my moms jewelry store that i didn't want to work at in the first place at 7pm because the girl was complaining of lots of customers (when there weren't any and she wanted to go out and drink)

Was driving my new mercury cougar down a road going 5 under the speed limit. A guy comes flying going about 55 in a truck towards me in the middle of the street. i brake, and try to veer to the left to dodge him, but not far enough to go into the other lane.

Because of this he misses the middle of my car but fucks up the entire right side (tire was in a ditch and frame is fucked up). Car shut off and he was in a ditch. i was fine, no air bags or nothing. was entirely his fault. i got out, went to go see if he was okay (he was in a ditch also).

He had cuts on his face but he was alright, and he told me he hadn't been drinking (but he kind of looked like he had). cops took forever to come, about 40 minutes. I called up my dad. cop came, recorded everything and cited the guy for failure to control. Guy said he wasn't speeding (which i know was bullshit because his skid marks will prove it) and he lost control of his vehicle's rear and that is why he hit me head on.

I was told by the cop my dad took care of the AAA since he showed the tower his card and the tower said he was fine. dad left to take one of his friends home and the cop tells me right before he has to go that he forgot to put in the AAA.

He told me he didn't have time to waste to call it and he was sorry and ordered my car to be towed since he wanted to free the street (as i was calling triple A back up). Whats left of my car got towed and i had to pay $110 to get it back. (cop said the guys insurance will cover it).

family is tried to tell me to go to the hospital to get myself checked out, but i'm fine and didn't have any injuries. car is in really bad shape. cop and a few people told me its probably totaled.

sucks because i planned to move in about 12 days. do any of you know if i can get a rental car or something for awhile because of this from his or my insurance?

i'll post up pics tomorrow....

talk about some bad luck....
 
your insurance will cover a rental for now if u got full coverage i think ...

Nah. Let insurance take care of everything, including the tow bill.

Remmeber that's why you pay for insurance. So you do'nt have to worry about this shit.

he also told me the guy that hit me's insurance won't cover a rental so in order to get one from my own, my insurance will go up.
 
Not 100% sure about US but as long as you have something called "loss of use" on your policy you get a rental, it just might not compare and there might be a 30 day limit or a cap of like $900 for a rental.

Depends on the State Laws. Michigan has no-fault insurance and your own company pays no matter who's at fault.

I got hit here in NY 3 weeks ago. Totally the other guys fault. He had Geico and they covered everything for me including the rental car for 2 weeks while the body work was being done.
 
In mass if you don't have rental, you are screwed. Not sure if his will foot the bill. I would fight for one from his company and also check your coverages.

This is why you should always get car ins. with car rental. Saving $5/month is not worth it when u get into an accident and now gonna be carless for a month.

And check ur loan - u might hvae gap insurance. Plus if you're not at afault, and depending on the state, they SHOULD cover the full market vlaue of the car (gap ins. would cover the difference if u overpaid for your car).

My experience when my car was totaled was that they gave me MORE than I thought it was worth. So I wouldn't stress too much on that.

You should call his insurance company to ask about the coverage on a rental. They should be able to help you. Your insurance company has nothing to do with this since it was all his fault (unless you have full coverage).

The at-fault party's insurance will get you a rental. If you get a rental through your insurance, they'll get the money back from the other party.

I'd suggest you stop listening to your dad on this, sounds like he's full of bad information. Talk to your insurance agent first thing Monday morning and get all the answers from him.

The car I mentioned earlier that got totaled was a '96 4.6L ford thunderbird. Basically same car as a cougar, cept mine was fast :)

They gave me like 3.5K for it and I bought it back for $175. It was drivable besides the passenger side door would no longer open :(
 
Im sure will have found out by now,

when my max was nailed by a pilot on the hood
the broads insurance covered my rental and I let them go 500 shy of totaling my car (I liked the car)

they gave me 2800 for damage on an ancient maxima with 220k for mileage
the other driver did however admit fault immed.

drove the car for another two yrs before Greg totaled it for real ...then totaled my jeep (fucker cant drive)


the whole thing was wrapped up ina week
I'd sream that you just bought it an argue the mileage to the adjuster...the adjuster CAN deviate from book value.....crawl all over the other ersons insurance company

Also, don't sign the medical release form until you're satisfied with the settlement, hold the medical release over their heads.

insurance agent hasn't called me back yet.

i think damage is over $4,000 and it will probably be totaled. thats just me though.

Any news from insurance? I wouldn't wait too long for them to call back, make a pest of yourself. Got a rental yet? That needs to be a priority, you need to start costing them money as soon as possible.
 
well dB, i don't understand nationwide.
my main agent has been out of town all holidays and his colleague won't return my calls at all. the past three days i've left him voicemails asking him to call me back and he hasn't at all.

the guy who crashed into me's agent won't return my calls as well.
the guy who did hit me won't talk to me, and my dad he recieved a fax that said hes trying to say the police report is wrong, and since i'm 20 years old it's my fault.

everythings in a big mess now man and i can't even get ahold of ANYONE from nationwide to even get an appraiser or car rental. I talked only once to my agents colleague over a week ago. he took a recording of my statement and told me he could not get me any kind of rental since this guy was trying to not take liability for the crash anymore.

basically i'm 6 days before i move with no car. tomorrow i'll continue calling them and leaving voicemails.
but i'm positive i'll never give nationwide another cent again after this.

you pay these jackasses to fight for you and they won't even return your calls for a week....

yes, i have. he left me one voicemail and has been ignoring me since he called. been trying to get ahold of him for a week as well. I talked to a lady that said she was sorry and would try to get to the bottom of this.

apparently the guy who hit me told his insurance company it was my fault and not his and that i was cited and he wasn't (he must be really stupid). so now his insurance company was trying to get my insurance to pay for it while my insurance has the police report. so i faxed them the police report. Apparently the lady i talked to said he received a rental car the day after the accident, and his car is in the shop now while i have yet to see an appraiser.

i'm taking dB's advice and heading up to nationwide tomorrow.
i was told the agent who ignored me for a week would get told off (what great that does for me).

so nice to hear that the guy who hit me got everything taken care of and is trying to get me to pay for his shit when he was cited and it was his fault.
 
here is what happened dB. my mom lied to my father and i and told the both of us it was full coverage without ever telling us the truth. today i went up to the office like you suggested. i talked to the secretary of my agent and she told me i was only insured under liability, nothing else. she called a couple of adjusters and an agent and had to talk to them and even talk to a manager before finding out what was going on.

apparently the other adjuster was faxed the police report a week ago and hadn't even looked at it, nor returned my phone calls for a week. his client (who hit me) told him it was my fault, even though it states it was his fault in the accident with a witness and documentation he was speeding.

since he has full coverage and i only have liability they are trying to say I'm not entitled to a rental car. i argued and they told me i could get one for three days only under nationwide since its not under my contract. It's day 11, and I was promised an adjuster will take a look at it in the next 3 days. my agents secretary told me they were treating me like shit since i only had liability coverage.

hopefully i get close to the $6000 i paid for it if they choose not to fix it.

Dang Iggy! Sucks your Mom did that. Luckily you had witness and report to prove the other driver at fault. They should give you the rental regardless if u have liability or not. Not your fault dude plowed into you. If they fight you over it then get an attorney to call them. It will shut them up.
 
Sorry to hear it. I'm w/ Phoenix. I totaled a nice, new, low-payment Nissan that I loved 2 weeks after I got it in a 5 car accident (I was car 4). I upgraded to a Volvo S80 because I heard they were safe. Safe yes, but also problematic. Fuckin' Swedes.
