still think its fucked up, I would look into legal action, just not right. Just think you could own triedia, call it smallsworld RD would love that.
 
Well, I agree with HI if Smallmovesal is against her pic being displayed.

However, I also find the fact that the word "pansies" has two different yet related meanings is a clue to the mystery of life.

i did a LOT of stupid things in the fall that i would love to kick myself over, but i realise it's the past and i can't change it.

i just think it's kind of funny that a bunc of people who think this board sucks constantly complain about it on another board.. generally if something sucks i tend to ignore it, unless it is sucking me.

Bottom line is:

Don't post photos of yourself if you're not willing to live with knowing that it might show up at sites like hotornot.com, mulletsgallore.com or any other sites.

If you can't live with ten million people gawking at you, then don't do it. Once it's proliferated there's no way to remove it, and the more you fight it the greater your chances of ending up like the family of mullets in ten years.

Your kids may see it in 12 years, hell your great gand kids might see it too.

I'll bet that May1010 hacked into the IRS database and used that to gain the information of certain board members addresses and then drove to their house dressed as a plumber and then knocked and knocked until finally since nobody was home he just ended up giving up.

I don't have a login at Tridwhatever so I can't see this pic or post comments about it - but if I recall correctly, smalls posted a pic on here that was relatively tame, and someone looked at the URL and saw that it went back to a web directory and they browsed all the photos there through the interface provided and found nekkid pics that way and then saved them.
I also recall that I was the one that went in and deleted the public pics for her when she couldn't figure out how - but that is obviously beside the point here since I'm a bad guy.

the point is, once anyone saves it, they can spread it faster than herpes.

It doesn't apply because she posted in a public forum. Her complaint is that the site was password protected, and that it doesn't constitute a public forum.


The defense would be, "She put it on the most public of forums possible and knew the consequences of doing so. Giving people access without solidly verifying their identity as per the 2000 Digital Identity Act is essentially giving it out to strangers and thus it's a public format."

Everyone owns the copyright to their own image or likeness and are thus protected by copyright laws.

I'm gonna start emailing my picture out to random yahoo and hotmail addresses (brute force with a bit of random thrown in - dictionary with mutation) with a picture of me bent over showing my o-ring to them.
along with the picture will be some text letting them know that I'm gonna sue for them having that picture. not to mention that I find it very offensive and an invasion of my privacy.

after that I'm gonna have some peanut butter.

No she can't prove who took it. But she could sue Triedia to remove the pics, and possibly for slander.

But it won't stand up in court.

Well, it's applicable if she can get someone like Ryan to read into the "spirit of the law".

But she's basically S-O-L. The site didn't ensure non-repudiation of the users, and thus can't ensure that the people downloading her picture were who they said they were.

may1010 is a guy who got banned some time ago, acts like he's gay but really isn't, and was pretty funny sometimes. i guess he's moved his act to triedia now. and what ever happened to HI kicking crimson king's ass?? that was the most interesting part about all this. no offense HI, but i'll give 5 to 1 odds on crimson king for any takers.

wouldn't the photographer own the copyright? I'm assuming that the pic was taken with a digital camera and there is no negative. So how could anybody prove where it originated?
 
Who ever posted it did it to piss her off not to give some lonely guys something to jerk off too. If she just ignores it sooner or later someones gonna be like...naked girl big deal and it will be done with.
 
I saw the pic over at Triedia, I thought there was nothing to be embarrassed about. Sure I can see how it would be upsetting to have naked pictures of yourself plastered on a forum without your consent.

But as to any legal action, I doubt there is really any real grounds. Look what happend with that Tommy and Pam video that was stolen from them. They fought tooth and nail to get those images supressed. No luck.

It was a tasteful nude pic, not worth getting upset over IMHO.

I agree, looks tastful to me. ..... and she looks pretty damn good, and she must have lost some weight around the hips.

Maybe some of the guys around here expect all women to look like porn stars....... I actually prefer the girl-next-door look, especially like small-to-medium sized breasts.

I understand all the comments made about the legal impact etc. But one thing you all seem to forget is this.

It doesnt really matter is she made them public or not. The point was that the picture was posted with a clear intent of inflicting emotional distress upon her. That is against the law, plain and simple.

She does own the picture, and asked that it not be posted by anyone.

Remember this, if she was to sue the person who distributed it, posted it and the site itself, she might loose (I doubt it), but the legal bills to defend the case would be huge.

So whomever did it, could be out to loose a LOT of $$ if smalls goes after them. DFG pulled the pic down both times case he knows this. The site shouldnt be held liable, but the people who posted it could.
 
The thing that pisses me off is this shoudlnt even be on Triedia. The only reason its there is because elites mods ban the members for no reason, or somtimes a reason but a stupid ass one and they come over to Triedia where they know they have th right to free speech.

If this fucking board could just fucking run itself correctly I wouldnt have to deal with the pissed off members from this board coming over to Triedia and I wouldnt have to deal with the mods from here coming over there trying to talk shit to me.
