cops found my gear in a search....

long story short, my brother in law and i are heading out to north dakota looking for work in the oil fields this week... he got pulled over by a oregon state police going 86 in a 55 zone...
the po was suspect of out luggage because it was wrapped up in black garbage bags to protect it from the rain, and asked him for consent to search the vehicle (if it were me i would have said give me the ticket and fuck off)... well, he goes right for my gym bag and pulls out a handfull of terumo's and it goes like this:
cop: whats this for?
me: i have a testosterone deficiency
cop: (pullos out 20mL vial of test prop) you have a script for this?
me: yes
cop: shouldnt your name be on it?
me: ya, it was on the box that it came in...
cop: (pulls out a tupperware) whats this?
me: some muscle milk...
cop: you work out?
me: a little...
cop: (pulls out a weight belt and another tupperware) whats this?
me: chalk
cop: well it looks like you work out more than a little...
me: i dont get in as much as id like to...
cop: (puts it back in my bag)
he let us go... no ticket... didnt take my gear...
off to dakota from spokanne today, im telling him to slow down out there...

Cool he didn't eff with you. It shouldn't be any biggie for a cop, but you know sometimes cops just look for any excuse to make someones life miserable.

cops will give you a break unless you are a prick to them, i had one pull me over going 103 and in FL you go over 100 and you go to jail automatically.. he started cursing at me and threatening me so i let him walk all over me and agreed with him.. he took my license and i figured i would be heading to jail for a night so i was putting my stuff together.

he comes back and says "you were going 103 why shouldn't i take you to jail?" and I tell him i deserve it and I'm sorry and I guarantee i will never speed again. so he sighs and hands me my license back with no ticket or nothing and tells me if he ever catches me speeding again he will take me to jail. had i fought back and been a prick to him he would of had my ass for sure with atleast a major ticket and a court appearance. anything over 30mph is a court appearance and anything over 100mph is jail in FL.

cops are people too so if they feel like they made their point they will let you slide, if they feel like you need a wakeup and disrespect them they will come down on you. human nature

and i don't allow people to look in my bag.. ever, mostly because i have to disclose that I'm armed...

oh for sure, though my brother in law was driving... my gear was in a duffel bag in the back of his pickup, i didnt think he would be dumb enough to concent to a search, though it seems it may have been what got him out of the ticket...

I wonder what would have happened if he didn't consent. Cops probably use that as reasonable suspician and get a warrant. They got you either way.

They can detain you for a reasonable amount of time as stated in the law! So, saying no to a search, will only result in a detained visit , while another officer delivers a search warrant to search your car or belongings! Some HP agencies can even have a copy sent to there computer terminal so they can print the search warrant , serve it on you , and then search your car! You cannot say no , because the right to drive a vehicle on a public road or highway is granted by the state !

Yeah I figure that is what they would do. If a cop ever wanted to search my car I would deny him access, assuming I had the time to be f*cked with, since I'm sure that's what they would do.
Say you have something to hide. You might as well say no. If they get a warrant, you could always challenge the validity of the warrant after the fact. (Was there reasonable suspicion).

I'm not sure this part is true. That argument is used for sobriety tests, and is called implied consent. You sign up for implied consent when you agree to the terms of your license. But I think implied consent is pretty much restricted to sobriety, not general searches of your property or your person.

I agree except you can say NO. our 4th amendment gives us the right to say no. Driving on a state highway doesn't give the officer a right to search you or you vehicle without probable cause. But remember (you or whoever) was speeding which is a violation ( and you can be brought into the station for this & be dealt with there... A summons is given in leu of an arrest.. If you say No the cop could get the warrant like above,, you lose.... If you say No the cop can take you into the station to give you the ticket & can search your vehicle for an inventory of what you have (giving you a copy of that inventory) & anything found could be used against you if illegal.
. So basically you get fucked either way.. IMO it's up to the person to make the decision of yes or no based on what they might have on them & the situation>>>>

But remember SHUT your mouth & get a lawyer if you know you are caught,,,, most people give too much info & help bury themselves..

Also any good lawyer will fight the warrant & searches on grounds of whatever was found was due to an illegal search,,,, "fruits of the poisonous tree".......

You are right to some extent sir. But when it comes to searching a car they can't use any reason for probable cause as just saying there were some black duffle bags in the car. And any thing that requires a lock, they cannot search if it is locked. Such as your trunk to some extent but mainly things like your glove box or even if you put a safe in the car.

This^^^. Speeding does not gv reasonable suspicion nor cause for search.

Thats why vehicle inventory is done if car is impoundable.

Its like this if am looking for a 50" tv i cant look in a bag. Likewise am look for a gun i can and anything that could be attached like ammo so i could go as far as a sealed envolope.

I cant wait till sm1 sues Cosco! Stoping u to check the recipt and ur basket is illegal search and seizure.

Definitely you acted right, and didn't get him riled up with you. I'm not sure what the laws are in other states, but the cops have to be very careful about civil rights, and it's easy to sue the police dept if they should cause you grief about legally-possessed items. It could cost them $mils if they made a mistake, and confiscated your prescribed meds.

But aside from that, I personally would not carry anything in my gym bag except gym clothes and gloves, belt, chalk, etc. Gear belongs in whatever bag you keep your toothbrush, Rx bottles if any, and personal stuff in. Just looks better that way, IMHO.

True the state grants the right to drive a vehicle on there roads. But as an American you still have rights. And just cause you are pulled over for speeding does not give the POLICE, HIGHWAY PATROL, FEDS whom ever to search your vehicle. Its called PROBABLE CAUSE. And speeding does not grant them that right. Now knowing there is illegal drugs in the vehicle the best thing to do is not give consent. Gives your lawyer something to work with.
