my apartment complex does random "saftey" checks every now and then. chekcing smoke detectors and shit. The problem with this is that sometimes I come home and see a note saying that my apartment has been entered by apartment officials. This happens with the fucking apt plumer and other utility people, they all have keys, they knock a couple times, then they just walk in and do whatever. Ok, well, a couple days ago, they entered and saw my cat, well, there are no pets allowed so now they are harrassing me. I asked my dad who is an atty, and he said it was illegal for them to walk into my apt without my approval, [invasion of privacy] I couldn't agree more, I'm so pissed that they do this, thank god I got the Bud I had out of plain view. I was thinking that maybe I unknowingly signed something on the lease that permitted this. Anyone else have this problem??? ------------------ | ||

Check your lease, Ill bet you signed the permission for this sort of shit. Although they have to notify you within 24 hours by either a note on the door or phone or something. ------------------ | ||

I would imagine that in one way or another this isn't legal. They just can't walk right into you dwelling. Even if you did sign something they should have to somehow, besides three knock on the door, notify you that they were going to need access to your place. ------------------ | ||

So they did leave you a note in your mailbox, but you didnt check it until a week later? They should leave that stuff on your door plain as day, thats what they do in my complex. ------------------ | ||

Mike this is what you do:: Place a Camera in your room when ever you think thay are coming in to do "Safety" checks, and if you are lucky enought to catch one of those mofos in the act of Opening your drawers and going thru your shit:: sue the bastards!!! | ||

Complexes I have lived in usually had someprovision about inspections, exterminators, etc. Clarify it with management - if you can. Also - find out what their policy on notifying you is. | ||

You're supposed to receive notice that they are entering. But the reality is that they know about the cat now and will get you for it. (Same thing happened to me) ------------------ | ||

NatyMike, what a coincidence!! I am having the same problem as you are! I came home the other night and I noticed that the kitchen light was on, and my bedroom door was open. Well, I didn't leave the door open or the light on, so I know those mofos came in while I was gone. I, like you, have a cat that isn't "authorized." LOL! I can't believe I have an "unauthorized" cat! Anyway, here is what I do. Leave your T.V. on and make sure it has decent volume. If those mofos come into your apartment and see the T.V. on, or hear it at the door, it is very unlikely that they will come in thinking that you are there, or leave if they open the door and see it on. I am with you on this one. While it is true that it is their property, you are paying to use the space. If you are essentially buying that space for a specified period of time, then in my opinion, it becomes your space until somebody else buys it. When they come in unannounced or without permission, then I feel that it is an invasion of privacy. | ||

If I remember correctly this is what I learned in real estate law class...If they need to enter for an emergency (broken pipe spewing water) they do not have to give any notice. If it is not an emergency, like your situation, they have to give a 24 hour notice. Putting a message in your mailbox would be considered notice so I don't think your case would hold up. I know it sucks, happened to me a few times. |
