OK A YEAR AND A HALF AGO I WENT TO PURCHASE A 1959 THUNDERBIRD CONVERTIBLE.I BROUGHT WITH ME A 1000 DOLLAR CHECK JUST TO HOLD THE CAR.THIS WAS NOT TO PAY FOR THE CAR JUST TO HOLD IT.I SPECIFICALLY TELL THE GUY NOT TO CASH THE CHECK.I WAIT A MONTH AND DECIDE I DONT WANT THE CAR.AND I CALL HIM AND TELL HIM THAT.HE THEN CASHES THE CHECK.I CALL HIM UP ASKING IF HE DID INDEED CASH IT.HE SAYS YOU GAVE ME THAT CHECK IN THE GOOD GRACE THAT I WOULD HOLD THE CAR.SO HE SAID I CASHED IT.I VERBALLY TOLD HIM NOT TO.BAD THING IS NOTHING WAS WRITTEN.BUT I DO HAVE ACOPY OF THE CHECK.WHAT SHOULD I DO? ------------------ HEAVEN IS THE BACKSEAT OF MY CADILLAC.

I don't think you can get your cash back, cause you gave him the money to hold the car not as a downpayment. I may be wrong hopefully I am, but if I'm not you can get some stuff back by slashing his tires, stealing his radio, and havin a good ol' feild day w/ his car. ------------------ | ||

Not sure what you can do klegally - seems like a whole lot of "he said, she hsaid" shit..... might as well buy the car now for the price -$1000, and then turn around and sell it for the same amount. Steel, I got the same thing going on with this kid who gave me $1000 dollars for holding a sport bike for him and he would pay me another 3000 when he gets, well 3 months go by and I get a phone call saying he doesn't wnat it anymore and then gets his mother to call me and tell me to give him back his money. The seller is in your case is in the right and the money you gave him is forfeit sale or no sale.

IM NOT GONNA PAY HIM 24 MORE GRAND.FUCK HIM.TALKED TO A LAWYER:HE SAYS IF HE SELLS THE CAR TO SOMEONE ELSE I GET MY MONEY BACK.AS OF NOW I OWN 1000 DOLLARS OF THE CAR NO MATTER WHAT.ALSO SINCE NO TIME FRAME HAS BEEN GIVEN AND SINCE HE HASNT NOTIFIED ME I CAN GO AHEAD AND PURCHASE THE REST OF THE CAR WHENEVER I WANT.HE HAS TO LET ME KNOW WITHIN 90 DAYS IF HE HAS A NEW BUYER IF HE WANTS TO HURRY ME.SO I THINK ILL SIT BACK AND LET THE JACKASS SELL IT SO I CAN COLLECT. ------------------ HEAVEN IS THE BACKSEAT OF MY CADILLAC.

put a lien on the car so when he goes to sell it you are guarateed to get your money. your do own a portion of the car and can collect. if he sells it and you are not protected then good luck. a lien will force him to settle it with you before title can be transfered. have your attorney hekp you with it. you can eventually get your cash back even though you don't deserve it. | ||
