Anyone know how long alcohol stays in the system to be picked up by a breathalizer? Lets say 3-4 drinks worth for my 120 lbs. girlfriend.

i will assume she is 20% bodyfat, that puts the LBM at 95 lbs. So if she drank 4 12 oz beers in 2 hours her BAC would be .169. As for how soon is she legal, depends on her liver, what she drank the day before etc.

Rule of thumb is more than 2 drinks and you will get DWI for the next 3 hours. everyone is different though but better to error on the side of caution here.

A P.B.T. AND A BREATHALIZER ARE DIFFERENT BUT WILL HAVE THE SAME RESULT.
P.B.T IS WHAT YOU ARE GIVEN ROADSIDE

To give you an idea, a shot of scope, can cause you to fail a breath test. If it is a 120 pound person, probably not a good idea to drive until the next day. with me even at 240 pounds, 2 beers and I am a blithering idiot and sick as dog for the next two days. It just depends on the person.

Poon Daddy, I thought I was the only one that would know what a pbt was. Are you a ___ or have you been nailed before?

For those who don't know, a pbt stands for preliminary breath test.

PBT is roadside - it is the breathalyzaer at the station which will determine if you will be charged. Some cops won't even charge you if you're at like .12 or .13 (assuming a .10 legal limit) because by the time you get to the station you will be under the .10

Here's a better rule of thumb:

IF YOU ARE IN ANY DOUBT (LIKE IF YOU HAD MORE THAN 2 DRINKS) REFUSE THE TEST.

You may "feel fine", but you aren't positive..... also, many states have a lesser charge (NY has DWAI - driving while ability impaired) which is like a .07 limit. .07 is really low, and you can have that and not even be feeling anything.

If you refuse the test, you will likely get your license suspended. You can say you were sick, or on medication - it doesn't matter - the bottom line is you cannot be convicted of DUI without the test, and you have every right to refuse it.

Skywalker is absolutely right. Whatever you do, if you think for any reason you are over the legal limit refuse the test. Yes you will lose your licensee for six months, but you can not be convicted of a DUI!!!

Refuse, Refuse, Refuse.

Also a side note. Most states conducted the breathalyzer with the Intoxilizer(sp) 5000D. Let me tell ya from first hand experience, it�s almost impossible to beat in court.

Refuse it, but refuse very politely.

Also, I would say that you should consider one hour for one drink. Of course, it will be different depending on what the proof of alcohol is.

On average it takes your body one hour to digest one and a half onces (one shot) of alcohol. But there are some things that effect the absorption and digestion of alcohol, such as the presence of food in the stomach, the type of drink, cocktails and carbonated drinks are digested and absorbed faster. For the most part these factors dont give a significant differnce though.
So to answer your question it will take three to four hours for her to be able to blow .00 hope that helps

In most state if you don't blow you will be charged with refusal to provide a sample on demand. When you signed for your drivers license you stated you would abide by the laws of your state and agreed to take a test upon demand.

Refusal is a misdemeanor and is usually punishable by 1 year loss of license. 1st DUI is usually punishable by 6 mo loss of license.

You can be convicted without a test but it is difficult. If you had witnesses that saw you pounding, your driving was caught on a dash cam, the field tests, if your were video taped at the station and so on.

So for the question, to test or not to test? I think you know the answer. By the way, if you were involved in a personal injury accident (officer suspects alcohol) you have to give a sample of your blood.

You should be informed now, that you can always refuse a breathilizer test, and ask to have a blood test done at the hospital. By the time you acually have the blood taken most of the alcohol should be out of the system, depending on what you drank. And the police are required to follow through with the blood test.

there is no formula to work out how it will affect you, there are too many variables to make an accurate calculation of how much you can drink/blood % you will have......each persons body absorbs it diffently and each different time you drink your body will absorb it differently due to current metabolism rate/ amount of food in your body etc..

Do Not Drink and Drive.
We shouldn't be consuming that much alcohol anyway. Get calories from a different source.
Not a teetotaler here, but driving impaired is stupid. I didn't get to 35 years old, by taking those kind of chances. Drink at home.

REFUSE??
What happens when you do?
1. refuse the PBT-charged with a refusal of the pbt.
2 Then you will be placed under arrest for drunk driving.
3 When you get to the station and you refuse there, they will seek a court order i.e. warrant, to take your Blood. If needed you will be held down to do so.
then you will be charged with interfering with a police investigation!
In court, a Blood test hinders your chances of getting off.
So the short anwser, to refuse screws you 10x worse.
and you gotta pay for the blood draw Etc, typical fee $300.
