Bros, From what I understand, no legal rulings have been made on the Napster issue. In other words, it is not currently a violation of any laws to post music on the Net, and Napster has disclaimers that say "Napster is not responsible for unauthorized distribution..." In other words, Napster claims to only be there to allow people to listen to each other's songs once uploaded. Their disclaimer should protect them from legal trouble. Metallica's issue is only with the unauthorized downloading of their songs. So on what legal grounds do they have a right to demand anything of Napster? Matt IP: Logged |

Platinum, That's deep. You're really smart. But if you buy it at a store, you own it. And it's PERFECTLY LEGAL to upload shit on the web on your own site, or another site like Napster. The questionable behavior comes in when you download it. Napster isn't software, and you don't need Napster to download it. I could put Metallica (or any file) on a site and it could be downloaded. Napster can't stop people from downloading things. But a listener site is not illegal. Platinum, I realize you may be handicapped upstairs by genetic shortcomings. When you buy a CD in a store you own the CD. Look at the copyright. You do not own the material ON THE CD. You simply own a little round disc that has the info on it. If you had a law degree or could do some research you might know this. YOU DO NOT OWN THE INTELLECTUAL PROPERTY OF SOMEONE ELSE. How's that for an intelligent answer. Once again, Owning a CD doesn't give you rights to the intellectual proprty on it. But it does give you the right to upload it on to a web site. And it is OK for other people to listen to it on the Web. Downloading it is in question. But Napster doesn't download it, all they do is provide a vehicle for it to be posted.
