Ok, here is the deal. I own a home inspection company with my Dad. We ispected a 15 yr. old house 3/30/00 and the buyer of the home never signed the contract with us which states that all areas which are reported on are what is visible at the time, blah, blah, blah. Also states that our liability is limited to the cost of inspection, in this case $315. In the report that she received from me states, "if the contract is not signed the report is not valid." So one way or the other I think I am ok. I try to cover my ass in any way possible. This woman, God I wanted to bitch slap her in the mouth, had an A/C service come out and clean the units, they said the air handler was a fire hazard. Oh, that's a good one, looking to sell a new unit they are. She also bought a home waranty at the time of purchase which covers any mechanical components, A/C included. The waranty co. gave her $1600 just for the air handler in question. Plenty to purchase a good one. But no, she wanted a top of the line unit, $2600. That is fine, but why should I pay for it. The unit was in proper condition at the time, I even have the temp. recorded on both units. WTF. We went into mediation and I almost lost it when she started her, I want them to..., they need to...They didn't do....Interupting me left and right, so I laid into her. Give me a fucking break. So long story short, we have to go to trial 4/20/01. Sorry this is lond winded, I just need to vent a little. ------------------     | ||

The only thing good about this post is that you have to go to court on 4/20(herb smokers holiday). Light one up with the judge for me. ------------------ | ||

Youre not responsible for someone trying to Bonk the system. The buyer would have to: a. Sign the contract giving you the right to inspect and determine values. Also, for you to be responsible to replace items would have to be in writing.(contract..which was never signed.) I think youre fine and shouldnt be responsible for anything. BE cool..or fake it | ||

Counter sue for punative damages, her bringing a frivilous law suit, your time, effort, court costs, etc. If your lawyer hasn't suggested this, then kick him in the ass. | ||

damn, that was fast. I dont really see where she has a case though. If shit goes out after the inspect... then wtf, where does the liability fall on you. | ||
