Yeah I wrestled with that one too, if you are gonna have freedom of speech it aplys to everyone, including the not so birght memebers of society. However this was a little different, he got right in the cops face and started yelling at him, this move can be viewed as threating. Then when the guy turned his body away from the cop, the cop could have thought he was going for a weapon or something. Its kinda hard to tell since we don't know the whole story. Chesty If i remember correctly you used to be a cop.
