Could someone get in legal trouble for going to the hospital? For example if a kid under 21 went there for alcohol poisoning, or if anyone overdosed on drugs, would he get arrested for underage drinking? What about if someone breaks a needle in their ass or gets a bad infection and had to go to the hospital. Could he get in trouble for steroid use, or is there a confidentiality agreement between the doctor and patient? Just wanted to know in case something were to ever come up.

There is definately a confidential relatinship w/ a Dr., but there are some exceptions. Most states have "mandated reporter" laws, for instance- if a Dr. belives, as an example that a little kid w/ broken ribs is being abused by her/his parents they are required by law to notify the authorities. A Dr. also has some discretion as to what may be told. A 12 year old w/ a drug overdose for instance would certainly need some parental guidance, and the Dr. *could* choose to inform the parents.

However, if you come in w/ an abcess you will probably leave w/ a lecture, if anything.

Judge Smales,
I'm curious about this, too. I was under the impression that there was no legal doctor-patient privelege in the same way that there is attorney-client privelege(sp?). I know this is a little different than a ER visit, but if I mention it to my doc, won't he put it in my medical record? The truth is I'd love to talk to my doc about AS, but I'm afraid that if I do, it'll go into my medical history and then anyone who wants to do a med check in the future - insurance, potential employers, etc. - can have access to this info. Is that right?

Broke a needle in your ass... Damn if that happens you would need to got to a shrink. No flame though. A doctor must report child abuse, spousal abuse, and gun shots..
Take a look at one of those inner city real life ER shows. The police would have to have a whole deparment just to deal with what happens at those places.
On a personal note: Had a freind (16) that was to smart for his good. He bought some blackpoweder and made himself a little firecracker. Things didn't go so well. I went to the ER with him. They only asked once how it happened. He told them a homemade firecracker. Never any questions.

Latona- this is where it gets a little hazey as to just what type of confidentiality you have. It's more of a custom of the profession than anything legal. You can definately ask your Doc to leave things between you two, but once something goes into your file it is definately accessible by all kinds of people. Fortunately for you the way this information usually travels is through a group of "encounter codes" that the Dr uses to report to your insurance Co. why you were at the office for and what the Dr. should be paid. For instance, you go in w/ strep throat. The Dr. reports ENC-2259 to your Ins. Co. Now everybody knows that you had a sore throat. There is no encounter code for "talked about juicing" so it's unlikely to get to the ins. Co. Most GPs however know almost nothing about juice, but your Doc. probably ought to know.

I hope that helps. I tried to boil it down, but it's a big topic.

Your Honor

Thanks for the info. That definitely clears some things up for me. I thought they just wrote regular notes. The thing is, if I went to him and mentioned the drugs and then he ran some blood tests and my bp was high or my liver enzymes were elevated, it still sounds like he could put the two together and then include steroid use in my medical history. I'm still a little reluctant to brooch the subject with my doc.

Probably a good idea in the long run. What you are risking in exposing yourself to down the road is really not worth what you might gain in info. from him/her unless there is some compelling reason to bring it up (like your eyes turn yellow)
