I just found out that my lifting partners boss just pulled him into his office and let him know that they've been reading his email. I know it's a company's right to read their employees email but what can they do to me? We openly talk about supplements and everything and I don't know if this prick is going to call my work to rat me out.Is it legal for them to do that? I know they can call the cops on him if they want but I didn't give them the right to read my email. My buddy isn't going to get in any trouble since the owner of the company is life long buds with his dad but they don't know me. I help him plan his cycles and give him advice and shit so I'm looked at as the bad influence. Well any advice or anything? Yes I must say that is pretty dumb to be talking about sensitive materials when you know somone can be reading it, and they have the right to be reading it.

Green, I don't think your bros boss will be calling your boss. That seems like an elementary school thing. What does your friend say? He can probably talk to his boss or father to clear things up.

If your IP can easily be traced, then you should probably get rid of all gear and gear related materials in your house. Advice is not illegal to give (even if it of a dubious nature). Get all of that stuff (including empty boxes and pieces of paper that can be connected to purchasing or receiving gear) out of the house and any storage facility in your name. Place them in a safe place if it is important to keep some of it. I wouldn't go as far as formatting your computer but erase any e-mails of an incriminating nature. Anything that is important but incriminating should be stored on a separate server on the Internet but do not leave any paperwork (passwords, username) lying around. These are precautionary measures but you have to be safe.

Well...unfortunately, even my capitalist instincts tell me that if you were aware that they could do this, it'll be hard to scream "invasion of privacy," but I'd just relax and cross the bridge when you come to it! ...can't wait to get my damn law degree... ------------------

I agree with the others hsould use hushmail, they can do whatever they want, those computers are the Companies not yours and your not supposed to be doing personal shit their anyways, never mind advising on illegal topics. This has happened in court already, and although things are shifting the outcome is always the same, the work is paying you to work, and your using there computers for work, simple as that. Id listen to 2Thick and clean house to be safe. Slopain

Thanks bros. I'll be cleaning up tonight and moving my shit to a friends house. I have 3 cycles of gear in my safe so hiding it isn't much of an option. You're right. We should of been smarter than this especially since I'm in the network industry. I know we don't monitor the shit here because I'm in charge of it but he works for a little dink company with no IT guy so I thought we were cool. Bad idea just to assume. Thanks for the responses. I'll let you know if anything ever comes of it. LAter, Green

In order for your privacy to be invaded legally, you have to have an expectation of privacy. For example, your taking a leak and your buddy is next to you and you are discussing drugs. You have an expectation of privacy because of where you are and what you are doing. Needless to say, you don't have that on the Internet. As far as calling the cops or your boss, they most certainly can do that. Say, you happened upon your little brothers e-mail, and he is discussing crack sales with one of his buddies, when there going to deliver, the whole deal, could you give the info to the cops? Sure. They probably wouldn't know what to do with it, and being preoccupied with car chases and gun battles (that almost never happen anyway) they might not do anything, or they may pass it on. It just depends on different things, like any past trouble you may have had, or more than one complaint like this. Now, could your e-mails be used against you in a court of law? It is still a new area of law, so there are no absolutes, in my opinion, Yup. They do it all of the time. You might get a good lawyer to have that evidence thrown out on a variety of legal grounds or various other legal tactics. The law is never black and white. To raid your house they need a search warrant, to obtain the warrant they have to have some really great evidence that there is not just a little illegal activity, (personal use) but a ton of evidence, that you are selling, trafficking and basically harming society. Only you know what was in your e-mails. So, only you know if they could obtain that warrant. My opinion: Doubtful. Point: Watch your e-mail, it is not private, you know it's not, so there is no expectation of privacy.

Bro, Email me if you want to know more about privacy laws and email. I am taking a class on cyberspace law now. Maybe I can offer some help, if the other guys in here can't. ------------------ |
