I KNOW I HAVE ASK QUESTIONS ABOUT CUSTOMS BEFORE, BUT I JUST WANT TO BE POSITIVE. IF YOU GET A SEIZURE LETTER, DOES THE INFORMATION SOMEHOW GO INTO YOUR RECORD. I MEAN THERE MUST BE SOMEONE ON THE BOARD THAT CAN ANSWER THIS. I AM JUST CONCERNED ABOUT MY RECORD.     | ||

Well first I hope you used a PO Box or a different name. Second I believe when they sieze your package they send a note and keep a copy in thier file so now that address is on record...but not your personal police record. I'm sure some other bros have first hand exsperience...so I'll send this to the top.. Chef ------------------ | ||

Nothing can go into your criminal file unless you are convicted of a crime. A rap sheet consists of all of the times you were arrested, regardless of conviction. I would imagine all that would happen is that your address is flagged or whatever they do. But you do not have a criminal record unless convicted, in a trial, or you plead guilty, to a crime. If you already have a criminal record it could go to the probation department or parole or whatever you are on, and you could get your freedom revoked. You have no rights if you are on probation or parole. | ||

I got a customs letter and I am on probation for a year....I ordered the gear with the same first name, variation of last name...so when go back to court they will know about this?... | ||

It's a possibility, but I wouldn't worry about it. It depends on how stringent your parole is. I mean if you're on probation for dealing steroids, you might wanna worry. But if you stole a candy bar or something unrelated it probably wouldn't. If your probation is for something serious, you need to cool it a little. | ||

Dude, I wouldn't worry about it. I'm on probation for four years (finally done in a month), and I order all the time without worry. IF your shit gets snagged, they send you a letter and that's it. They probably know that half the orders they grab are fake names anyways, why would they check on every name they come across? Plus, you aren't found guilty of anything if they snag your shit and send you a letter, so they can't do anything to your probation. I'd still be carefull, but I wouldn't sweat it. | ||

Even if you use your real name and address they still cannot prove you ordered the stuff. Anyone can send anyone a package, just because it is addressed to you doesn't mean you know what is is. [This message has been edited by X-Man (edited September 11, 2000).] | ||

I wrote a post a while ago about how you actually can get busted by the Feds for anything. When drugs or organized crime is involved, they throw in this thing called "conspiracy". It pretty much gives the Government free rein. It's not like with our State Courts or even Federal when dealing with other things besides criminal groups, or a collection of people who are only gathered together to commit crimes. This is where you can be lumped in as part of the conspiracy. This is how they got John Gotti and several gangsters. It's mixed in with the RICO statutes I believe, and gives the Government the power to rape you if you are involved in anyway in this type of crime. The evidence does not have to be solid, just anything that MAY draw you into the Conspiracy to sell, obtain, move, whatever, an Illegal Substance. |
