Yes, they have the same authority off duty as on duty. They must, however, be in their jurisdiction, if not, they still can act but it would be as any other citizen. Except, even outside of their jurisdiction they may be armed and they do not have a duty to retreat as does a citizen. In other words, if out of his jurisdiction, he has "a duty to act" but no powers of arrest. Say you were doing something and the off duty cop confronted you. You said fuck you and hit him. At this point (had he not identified himself) he could not charge you with battery on a police officer (felony). He would be able to arrest you on battery charges (misdemennor). If he attempted to arrest you (after Id) and you continued to resist, then you would be charged just as if he was wearing a uniform. IP: Logged |

It doesn't matter what city they are in or whether they are on or off duty! They can make an arrest in the STATE they are an officer in PERIOD! Although, they will need officers from the city the arrest was made in. IP: Logged |

When a local cop is out of his/her city (jurisdiction), Deputy Sheriff is out of his/her county (jurisdiction), or a state officer is out of his/her state (jurisdiction), they do not possess the powers of arrest. They can act if they see a crime in progress and hold the suspect till an officer from that jurisdiction arrives. The officer from that juristiction may then make an arrest. It is the same power any citizen has, if you see a crime in progress you may make a citizens arrest (legal authority to hold the suspect; ie security guards and shoplifters). If you live in the city of Jacksonville Fl and are driving on I 95 and speeding to beat hell. Say you pass a city of Miami cop in a squad car (who is returning to Miami from a training class). The cop from Miami has no authority to cite you for the offense. The only thing he could do is stop you and call for a Jacksonville cop. And truth be told, it would never hold up in court because the Miami cop had no authority to stop you in the first place. IP: Logged |

I am chatting online with my friend who is an officer right now and he said that if a felony is committed, then they have the power to arrest...anywhere in the state where they are officers. If it is a misdemeanor in the county where they serve they can arrest on or off duty, but only in that county. ------------------ IP: Logged |

If it is a felony they have THE DUTY TO ACT They cannot complete an affidavit outside of their jurisdiction. They can place the person into custody, and turn that person over to the agency with jurisdiction where the crime was comitted. IP: Logged |

Law Enforcement officers were liken to pigs during the riots of the 60's. It stemmed from the use of the gas masks they used. That style of mask had a large cylinder which screwed to the front of the mask. The cylinder was the air filter. This, however, made it appear as if they had large round snouts, much like that of a pig.

I hate cops. Nothing pisses me off more than when I am rolling on the highway and some cop speeds past me doing 90. If they want us to go slow they should have to set an example. That is not fair that those fuckers get to speed and we don't. I know there are times when they need to but they ALWAYS do. They have to follow every other law, why not that one. FUCK ALL COPS. FUCK the pigs I have some friends... who are pigs.. and all of them have done cycles .. and 2 have done cycles this year and both are on the job.. LOL all this Bullshit about Gear usage and its legality .. But as my friend explains it.. Most of His suporvisors.. Would rather have some 250-300 Lb ripped monster coming to his foot chase of someone fighting one of his own... Then some lil 90 pound chick who is worried about breaking a nail..... Whoever that was complaining about the police speeding... The reason that they usually speed is b/c they are in a rush to get on the scene of an accident, or some sort of emergency. I am sure that you wouldn't mind them speeding if you were the one in need of CPR and no one knew how to administer it, or if you were bloody from a car wreck. As much of a pain in the ass that cops are, they put their life on the line each and every day to protect us. I agree that not all of them are good, but thats like saying all blacks are criminals.
