Does anyone know of any good web-sites for researching Criminal Law Cases? I got a bullshit charge of Assualt on an Officer at a club over Spring Break. He was working security but was dressed in his "regular" uniform. Needless to say, there was a scuffle and he and several Bouncers were injuried and I had to spend 3 days in jail!! WTF. They have charged me with a felony!!! The charge carries a penalty of 2 - 20 yrs in prison. I thought they were just tring to scare me but they seem intent on tring this case. The prosecutor is a ball busting old hag and she has it out for me. Enough with the storey... I need some research material to find out what to do. I never punched the cop and I am innocent of that charge but I have no witnesses and they have a lot. They offered me 6 yrs of differed ajudication but I have to take piss test and do community serverice..so F*** that. Has anyone ever had an experience like this or can someone point me in the right direction for researching this. I have a lawyer but he is a slimeball and I dont trust him... PLEASE HELP.. ANYONE!! I have a public defender... can not afford a "real Lawyer". I want to know all the facts so incase he is a fuck-o, I can advise him and make other decisions if necessary. Bro, you need to go to the law web page for the state you live in. For instance, I live in NJ. I would go to AOL search and type in NJ Law. It should give you all the statutes and laws. By the way, I would not worry about going away for too long if you are convicted. I worked for the Mercer County Prosecutors office in NJ last year. If the cop was not hurt, he may decide to downgrade the charge. You could also go to the library to look up the laws in your state. Good luck, and let me know how you make out. p.s. It's a shame this did not happen a few years from now. you should contact your local bar association, or call a local law school and ask them for free or low cost legal representatives. there are usually clinics where you can go and pay like 50 or 60 bucks to talk to a lawyer and he or she will answer your questions. when you call to set the appointment tell them what you are being charged with and they will set you up with someone who specializes in that area. legal issues and court cases are like medical problems...never settle on one lawyer to decide your life, always get a second opinion. Thanks D, I live in texas and the cop claims that I turned around and punched him in the face. This did not happen. I think they were going to arrest me for a PI or for being a large guy in a club full of little pussies. Who knows. Thanks anyway. IP: Logged |

battery is when you actually hit someone, assault is a threat...got charged with that along with other stuff a while back, judge threw the case out..the cop apologized to me after wards as well, it was to late..your not getting jail time...bar fights are nothing new IP: Logged |

If your lawyer sucks, take the plea bargin. You will be off in half of the time, and they dont piss test for roids. Cops lie that is just a problem you have to deal with. Or just kill them all and run for mexico. IP: Logged |

Hey no offense to you but all the cops I know aren't going to lie about a stupid bar fight (where everyone else is drinking expect for the cops) Why don't you tell us exactly what happened...my guess is you were either running your mouth or didn't leave when the cops told you to leave. Lets face it people...when the Police tell you to leave a place and you do (while keeping your mouth shut) you don't get arrested.... IP: Logged |

Do not take any pleas and get a real lawyer. Otherwise you will be sorry for a long time as these charges will prevent you from getting jobs, owning guns and a lot of other things. A court appointed lawyer is not the way to go. Also, they won't test you for AS, Doesn't matter what you look like. IP: Logged |

If you are guilty, which I assume you are, a public defender would be your best bet because they work with the same judges and prosecutors all the time. High priced fancy attorney's are seen as outsiders in a system were 90% of cases are plea bargains by public defenders. You will always get a better deal with a public defender. A-Bomb, I know what I'm talking about -- you need an attorney, and quickly. That said, don't panic. We can handle this situation. Almost always, this type of infraction never makes it to court -- some sort of agreement is made with the prosecutor before it gets that far. The longer you wait, the harder it will be to change the prosecutor's mind about what happened. I highly suggest that you get your money together and get an attorney with criminal defense experience in the city where you're charged. If you can't afford that, you need to work the system to get a good public defender (and despite what people say, there are some). If you don't like the public defender you have now, tell him or his office that you're not getting along and want your case to be assigned to another public defender. I have met public defenders that are more competent than high priced attorneys. In fact, I know guys who do it because they believe in the service. They have been offered numerous jobs in the private sector, but they choose to do what I believe is a very respectful job. If you are guilty, they are your best bet for a good plea bargain. (since they hammer out bargains with the same prosecutors and judges every day, again, private attorneys are seen as "outsiders")If you are innocent, a good private attorney will be able to put forth more of his time to your defense.
