I am close with this bro and he had a run in on Easter. He has dedicated his time,money and ,effort into a product that he has come up with. IT IS DAMN GOOD ALSO! Called NITRO BURN... Well here is what happened to him: This is what he said: I just got out of jail lastnight. I have made up mind that I am completely fed up with law enforcement. I was coming home around 3am and was stopped by a officer for having a blown head light. He was going to let me off with a warning for the headlight, but he wanted to run me through the computer to make sure that I had no warrants. He goes to his car. I am sitting in the car impatiently, because I was tired. He comes back to the car and begins asking me questions about my previous drug conviction a year ago and that I am on probation. I told him that I had gotten in trouble for possession of steroids, so he asks me to search my car. I wanted to say no, but I thought that it would be suspiscious and that he would just call in for a warrant, so I said yes. I had a bunch of gear in a book bag on my passenger seat. I didn't think he was allow to go into my book bag without permission. It doesn't matter if he was or not he went through my bag where he found 6 50ml bottles of Winny, 60tabs of Dbol and 2 50ml bottles of Ketamine. He then cuffed me and put me in the car. He took me to the police station where they started to ask a bunch of questions and try to scare me. I think they were disappointed because they couldn't scare me. I told them that I know I am going to jail this time so don't waste their breath trying to scare me. Oh yeah they also took all of my money. It was all of my Nitro Burn money (I am paranoid of banks so I always keep every penny I have on me). So I am extremely pissed and extremely poor now. I don't have any money to hire a lawyer this time. I am not worried about going to jail, but I don't want to spend any more time than I have to in the pen. The better the lawyer the better my chances right. Good lawyers are expensive. I don't know what I am going to do. I just hope my company doesn't go under while I am in jail. I have worked my ass off and the "fucking government" is going to trash my dreams. I have been doing research studies on steroids for 5 years. There is got to be some legal way that I can do my research so I can stop giving money to Uncle Sam and Lawyers. I will figure it out. Well I am going to go now. Sorry to hear about that bro. For anyone else in this situation. Do not give permission to search your car. They are legally able to search anything within arms reach of you without a warrant. so move anything far away from you, best place is teh trunk. They cant get a search warrant based on a prior conviction. you still have rights. They will get a dog to try to get some PC but they cant smell juice so that wont work. I repeat never let them search your car. Now if you have other drugs in there that dogs can smell you will be in trouble. | ||

OK- You had a narcotics conviction last year,are on probation,driving at 3 in the morning with a broken headlight...stop me whenever...I don't think you could have done worse if you tried.(not a flame) The worst thing you did was give permission to search the car.With that amount you won't get into too much trouble..just keep quiet!!! Dude, I feel your pain seriously! But you should NOT have let him search your damn car. You brought it onto yourself. Why would you ever give a cop a chance to collect more evidence against your ass. (Even if you dont have anything to hide, always deny the cops!) My friend Ryan is a lawyer, and there is a quote that echo's in my mind all the time: "XXXX, I would like to see a cop try to search my car without a court warrent. I know my F2cking rights". Anyway probability has it, that you might not even get your money back, because it was siezed along with your juice, which makes it suspect. Get a good lawyer, but dont have that many hopes! Uphill battle allt he way. Best of luck bro

The cop would probably search the car anyway. Probable Cause is all they need to search your car without your permission. In this case, the "Probable Cause" to search it was the fact that the guy was already on probation from a prior drug offense. They do the same thing when they pull you over if you have a prior weapons charge...They are just a lot more careful when it's a weapons charge...Trust me I know. Fuckers got me one time for having a pocket knife that had a blade over 3" No flame and your buddy may be a good guy, but common sense isn't one of his strongpoints. A cop I know said that simple violations like a headlight or tail light out, tinted windows, a crack windshield, or even unclear plates, lead to ALOT of arrests. They pull you over for these reasons(which are legal) and then if your high or if they suspect you have drugs or a weapon in your car they'll search it. Even if your friend said no, you can't search, they'll just get a warent a search it anyway. If I had something illegal in the car I would have said no, maybe there is a chance they can't get a warrent, and you'll get away. | ||

The cops can only search the car if they have probable cause. If they dont have that, they might try and whip out a K-9 unit and try to sniff something out. But other than Parabolan, no other steroid that I am aware of has a smell. ------------------ | ||

AJC yeah thats what I thought...probably cause. And shit I always carry a knife in my car...and i think the blade maybe 4-5 inches. Ive actually had it open on my seat when i was pulled over. thank god he didnt see that. whats the rules on knives anyways? | ||

Cops are only allowed to search a vehicle if they have probable cause and not just a hunch. If a cop walks up to the window of your car and gets a good whiff of burnt weed, and he looks at you and your eye's are all red, and there a joint sitting in your ash tray, that probable cause to say there's marijuana in that car and now he has the right to search it. You need to have a motor vehicle violation in order to make a stop. They just can't stop you because they feel like it. Once they do that whatever comes out of it is fair game(ie the marijuana example). But just because you had a prior record is not probable cause for him to search your car. If he did anyway, thats an illegal search and seizure. But since you allowed him, that was your mistake, you sliced your own throat. Just for future reference, if anybody else has a similar situation come up and the cop asks you for a consent search just say "You know, I talked about this with my layer one time, and he told me that I have a RIGHT to refuse because I have a RIGHT to privacy." After that, he has no probable cause to get a warrant or a K-9. If he does anyways, it'll NEVER hold up in court. Sorry for the long message, hope it clears things up. | ||

Actually, in the state of North Carolina an officer can search your car without a warrant if they have "probable cause." I was told this by a police officer. Just throwing that out there..... | ||

Alright guys - I have a question. This may seem to dumb to you, but I honestly wouldnt ask if I didnt know. Ive read, and understand everything you are saying about probable cause ---- but what if they pull you and you have a spotless police file? If they are pulling you for a tailight and you are clean - is there anything at all that they could claim as probable cause? | ||

Yes cops can search your car without a warrant if they have probably cause. ie the marijuana smoke and red eyes. However, if they are ASKING you if they can search, they probably DONT have probable cause. Just tell them no, and let them know you are aware of your rights to refuse a search. If they try pressuring you by telling you they will get a warrant, tell them they are not allowed to pressure you, they have no probably cause to search, and the answer is NO. | ||

Probable cause basically means "he probably did it". Meaning, if a cop walks up to your window and see's a bag of dbol or 12 amps of test sitting on your passenger seat then he has reason to believe, probable cause, that you are in possession of steroids. Just keep them in your gym and keep the bag in your trunk and you have nothing to worry about. Don't even leave one pill lying around, cause that's all it takes. Keep the passenger compartment clean and you'll be all set. And if they ask to search your car, just say no. They can't force it. | ||

I mean, stash the shit at your grandma's house or somewhere they'd never look. ex. a metal box strapped under the car that looks like a part of the frame but inactuality it holds thousands of dollars worth of gear! Let me just say to NEVER give them permission to search your car even if you know you don't have anything. If they ask you, that means they don't have probable cause, because if they did have probable cause, they wouldn't ask you. | ||

Most times when you go on probation for a drug offense, one of the conditions of probation is to submit to a search by any peace officer (to deny them the search would be a violation of your probation) when asked to do so. Chances are that he would have searched the car anyways since he was on probation and probably gave up his right to say no to a search of his body, vehicle, or possesions. I do agree that he should have used his head before he got into the car with all of that gear and money. Kind of funny (well not funny) that he doesnt trust banks but now he has none of it and not one bank was involved in taking it from him. DreamingBig | ||

that fucking sucks..... if he just would have said no to the search. they usually don't have time to wait on a dog to walk around the vehicle. Also, the dogs aren't really trained to smell the juice. you never know what your buddy two weeks before stuffed in you back seat. never,ever allow a city cop the right to search your vehicle. | ||

No flames here guys but it varies from state to state. If you don't give permission to search, then the only way they can look is if you are under arrest, then they are inventoring the vehicle for the tow report. But put it this way, if an officer wants to get in your car, he will find a way. Example is, sir, step out I want to talk to you for a minute. Now when I approached you I saw your shoulders and upper body move forward so for my safety i'm going to look in the vehicle..... see, even if you didn't lean forward he can articulate he had a reason to look. P.S., no car can go a mile down a road without committing some kind of violation, according to an officer. Sorry long winded, peace. |
