If I order from a source in Texas, that means no customs what would be my chance of siezure or If should I get gear from a Guy in Spain who claims that customs leave Spain along?

Your guy in Texas should be fine. Have him send it regular postal mail. I've done it a few times and never had any problems. If your foreign source is legit, he should resend your order if you send him the letter of seizure.
