Just wondering on the legality of this. But is giving the name of a source to someone interested in buying AS protected by the "free speech" clause of the first amendment. Or could you charged with some sort of "conspiracy to sell a controlled substances" just by giving the name of a source. Any lawyer wannabe's out there? | ||

I am inclined to say that it is totally legal to give out a source. I mean, there are books published on how to build a nuclear bomb, and how to kill someone and not get caught. So the simple information is not enough to get busted....I think you must act on that info and actually commit the crime (buying a controlled substance). But I am speculating here. Anyone else? | ||

I don't think it's legal..I was watching something one time about if someone comes up to you in a bar and ask you where they can get some coke(or any drug i guess, that's just the example they said)and you point them in the right direction you can get in trouble as well. | ||

I believe its called "conspiracy" and in the narcotics world, can get you serious prison time, even when no money or narcotics ever changes hands. Just connecting one person with another for the purpose of dealing controlled substances is a crime. In fact, conspiracy charges can land one in prison for longer periods of time than violent crimes in some cases. F1 | ||

I am an attorney, but with very little experience in Constitutional law...however, I am pretty sure that under the 1st Amendment you can talk about almost anything you want (short of slander, etc.) in a private forum...but, giving out the name of a source is probably a "predicate act" under the current conspiracy law (of which there are both state and federal versions) if there is the requisite intent - that is, both parties intend to exchange the information for the purpose of obtaining contraband...also, the way in which we exchange the info - internet and telephone - may implicate state and federal wire fraud statutes | ||

Ferrus is 100 % correct.I think it also is called Compelling..To entice, procure, solicit or encourage the use of any illegal or "harmful" substance. But to cover your ass..you can say that the info given is for entertainment purposes only or some stupid crap like that. And if it is a minor and you get caught giving this info out for "non-entertaining"purposes..your officially screwed.--usually a Felony of 2nd degree in most states. -8UP- | ||
