ANY amount is a felony. The real issue is that it is up to the individual inspector or agent to decide for himself if he is going to apply for warrants. At this point the US attirnies office will look at the case and decide to go forward or not. For all intents and purposes, if the amount is negligable, for instance one or two tabs, they don't want to waste the time. A full bttle that's a different story.
