So tell me then.... what class are these drugs and what legislation governs them. (I'll give u a clue... 1968..)
I'm not being funny m8 but it's only in America that your first point is valid. In the UK it does'nt work like that. i.e. it does'nt matter what I believe the substance to be, it only metter WHAT IT ACTUALLY IS.

In English law ==

Actus reas - Guilty Act -
+
Mens reas - Guilty Mind -
=
CRIME

One can never be exclusive without the other (with the exception of certain types of manslaughter.)
